HomeMy WebLinkAbout38.27 ORDINANCE NO. 38.27 AN ORDINANCE OF THE CITY OF SARATOGA A~.~NDING'DIVISION TWO OF ARTICLE V, .CHAPTER 4, OF THE SARATOGA CITY CODE RELATING TO PEDDLERS' LICENSE8 The City Council of the City of Saratoga does hereby ordain as follows: Section l: Division Two of Article V of Chapter 4 of the Saratoga City Code, which Chapter is entitled"Business Regulations", is hereby amended by adding to Section 4-108 thereof the following provisions: Where the application is for a peddler's or solicito~,s license, and.'the ~ame is exempt from license fees under the provisions of Section 4-120 hereof, and where the licensed person or organization plans to operate through one or more employees, a single license may be issued to the employer-applicant, together with business license identification cards for each of such applicants-employees~ and a separate business license for each such employee shall not be required to be issued. Section 2: Division ~o of Article V Of C~apter 4 of the Saratoga City Code, which Chapter is entitled "Business Regulations", ishereby amended by adding thereto the following Section 4-109.1, as'follows: SECTION 4-109.1 RETURN OF~ SOLICITORS LICENSE UPON EXPIRATION: Any person having a peddler's or solicitor's license and/ or identification cards, shall be obligated to return such license and all such identification cards to the City Clerk upon the expiration of the term of the license. At the time of the 'issuance of the peddler's or'solicitor's license or identification card or cards, or both, regardless of whether or not the applicant is exempt from license fees, the City Clerk shall require, in addition to the payment of any applicable fees, a cash deposit ins sum equal to the amount of such license fee, as a bond to guarantee compliance by such peddler or solicitor with the provisions of this Secfion as to the return of said license and any and all identification'cards, In no event shall the sum deposited as?a guarantee for the return of identification cards be any less than the sum of $5.00 for each such identification card. In the event that the applicant, or the business, or organization, is exempt from the payment of license fees, the amount of the dash deposit to guarantee the return as aforesaid shall be an amount equal to the license fee that otherwise would be applicable in the event the person, organization or business were not exempt. Upon card ho der any failure of the licensee or identification 1 to return the same in accord herewith, the City Clerk may declare the bond therefore forfeited to the City. Section 3: If ~ny sectiOn~ subsectiOn, sentence, clause -1- or phrase'of thi~ ordinance is for the any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Saratoga hereby declares that itwould have passed this ordinance and each section, subsection, sentence, clause and phrase therSof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be held invalid or unconstitutional.
