HomeMy WebLinkAbout38.29 ORDINANCE NO. 38.29 AN ORDINANCE ADDING ARTICLE VIII TO CHAPTER 4 OF THE SARATOGA CITY CODE, RELATING TO SWIMMING POOL SERVICING The City Council of the City of Saratoga does hereby ordain as follows: Section 1: There is hereby added to Chapter 4 of the Saratoga City Code, which Chapter is entitled "Business Regulations" the following Article VIII, which Article together with all its Sections and Sub-sections thereof shall be as follows: ARTICLE VIII-SWIMMING POOL SERVICING: SECTION 4-400: Swimmin8 Pool: For the purpose of this Article, the term swimming pool shall mean and include both public and private swimming pools, including all special use pools. ~ECTION 4-~01: Registration and certification requirements: No person shall engage either in the business or occupation of treating swimming pool waters, or of cleaning filters, heaters or other appurtenances or appliances used or usable in connection therewith, or ~n the business of maintaining swimming pools or facilities or appurtenances or appliances thereof, within the City limits of the City of Saratoga, unless he is certified or registered in accord with the provisions of Article 13, Chapter 1 of Title 5 of the Santa Clara Eounty Ordinance Code, or unless he is expressly excused or exempted from such requirement by the provisions of said Article, Chapter and Title of said Santa Clara County Ordinance Code. Any person registered or certified under the above provisions may lawfully engage in said business or occupation only to the extent permitted pursuant to said registration or certification. Section 2: This. ordinance shall be operative on and after July 1, 1969. SeCtion.3: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decisions shall not affect the validity of the remai~ning portions of this ordinance. The City Council of the-City of Saratoga hereby declares that it would passed this ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be held invalid or unconstitutional.
