The City Council of the City of Saratoga does hereby ordain as follOWs:" Section 1: The following subsecti6nS are hereby added to Section 9-71 ofthe Saratoga City Code,'contained in Article VI of Chapter 9thereof, relating to the operation of bicycles,,.to read as follows: Section 9-71.1: Every person riding a bicycle upon a street or highway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicl& by the laws of this State declar- ing rules of the road applicable to'vehicles, or by the ordinances of this City applicable to the driver of a vehicle, except as to those provisions of laws and ordinances which by their nature can have no application, and except as otherwise provided herein. Section 9-71.2: Any person operating a bicycle shall obey the instructions of official traffic control signs, and other control devices applicable to vehicles and bicycleS, unless.otherwise directed by a police officer, Section 9-71.3: Every person operating a bicycle upon a roadway shall ride as near to the right hand side of the roadway as ~ ~c'able, exercising due care when, tion. Persons riding or operating bicycles shall not ride more. than two abreast, except onpaths or parts of a street or highway designed for. the exclusive use of bicycles; provided,.that all persons'permitted tO ride, use or operate a bicycle on a sidewalk or pedes- -. trian path shall do so in a single file. · Section 9~71.4: No person sha~l ride, use or operate a bicycle on any Sidewalk or pedestrian path within the City of Saratoga except as specifically permitted by · '- this.Code. " · Sedtion 9-71.5: Children und~ the age'of ten (10) years shall be exempt from the provisions of Section 9-71.4, provided that said exception shall not apply to any.child'under'the age of ten (10) years who fails to .~. exercise, or is incapable.of exercising, due carerror · ~ the rights and safety of all others using any sidewalk ~ Or pedestrian path and, provided further, that in ~n~ event said exemption shall not apply to the use and operation of bicycles on any sidewalk or pedestrian path- in any commercial zoning district. Section 9-71.6: The operator of a bicycle emerging from an alley, driveway or building shall, upon approaching a sidewalk or the sidewalk area extending across any alley-wayS'yield the right-of-way to all pedestrians a~roaching on said ~fde~f~fd~g~fk'~rea~d yie[d"~h~e right-of-way to all vehicles approaching on sa'id roadway.. Section 9-71.7: No personshall ride or operate a Bicycle upon a street or highway adjacen~ to ~ich, or upon~ich, bicycle lanes have b~en designated, except within such bicycle lane, or except as otherwise permitted herein. Section 9-71.8: No person shall ride or operate a.bicycle within a bicycle lane in any direction except that permitted of Vehicular traffic traveling on the same side of the roadway, save and except such bicycle lanes as have been designated for two-way bicycle traffic, and which are clearly sign-posted or otherwise identified b~ painting or markings as to two-way bicycle lanes. Section 9-71.9: U~on approaching a st~ee~ intersection any person riding or operating a bicycle shall yield the right-of-way Eo all vehi'cles within or approaching such intersection 'except that all vehicles,which must stop before entering an intersection because of a stop sign and all Vehicles making a left-hand turn at an intersection s[{all not proceed into said intersection nor make such a turn without first yielding the right-of-way to all biCyCles within or approaching said intersection and shall proceed 'only when it is safe to do so. Section 9-71.1~: Once having entered a bicycle lane, no person ,~ ~,, riding or operating a bicycle shall leave such lane except a~ inter= sections; provided, however, that such person may, leave a bicycle lane upon dismounting from a bicycle,walking the same, and being subject than to all laws applicable to pedestrians. Provided further, that such person may leave the bicycle lane between intersections in order to make 'a U-turn, where such a turn is permissible for vehicular traffic or to turn into driveways on the right ,or left hand sides of' the bicycle lane. Upon leaving-a bicycle lan~, the rider.or 8perator of,such b.icycle · shell yield ~he right-of-way to all vehicles and shall not leave the bicycle lane until it is safe to do so. ~. ~, Section 9-17~i.11: Bicycles may be walked subject to all provisions of law applicable to pedestr~i'ans. Section 9-71.12: No person .riding or 'operating a'bicycle shall carry or transport another person on said bicycl~e unless said person carried or transported is seated upon an individual seat or carrier '- affixed to said.·bicycle which is separate from that used by· the Operator. ' ' Section 9-~1'i15:' Bicycle-lanes~ separated'fr6m · vehicular lanes, on public streets within the limits : this City'are-h~eby established and'approved, the location of each such bicycle lane .robe as m~y from time to time hereafter be established by either minute or formal res01U-. tion of the City council of. this City. Upon the approval of the location of such~bicycle lane Or !anes, the City , Engineer is' authorized to'erect o~ place signs upon each+ street in. this City indicating the existence of .the same and otherwise regulating'the location and use of vehicles and bicycles with respect to each other on such street.Or streets. Before any such sign is erected, each~ bicycle lane shall be designated on-such street y an approved p~i~ting on the surface thereof, or in such other · manner as the City Engineer, on approval of the City Council, shall determine will provide.sdfficient n~tice of existence of s~ch bicycle lane. When such painting,_a~d_d signs, or other. designation'-are in place, no person shall .disobey the same. Section 2: ~f an~.'~ection, .subsection, sentence, clause orphrase of .this ordinance is for any reason held by a court of competent jurisdiction to be invalid, 'such decision shall not ~.~ .... -affeCt the validity of the remaining, pQ~tiohs of .this ordinance. The City Council of the City of Saratoga hereby declares that it n c ~, h. irrespective of the fact that any one or more se~t~ons,-sUbsections, sentences, clauses or phrases be held invalid or unconstitutional. Section 3: This ordinance shall take effect and,be in 'full force and effect thirty (30) days after the date of its passage and adoption.
