AN ORDINANCE OF THE CITY OF SARATOGA
MODIFYING THE PROCEDURE PRESCRIBING TIME
AND METHOD OF PAYMENT AND RATIFICATION
OF PAYROLL AND REIMBURSEMENT OF FUND
The City Council of the City of Saratoga does hereby ordain as follows:
Section 1: Section 2-30 o~ the Sarat6ga City Code is hereby amended to read
as follows:
Section 2-30. Same -- Issuance of. Pay~oll'Checks
Pursuant to the State Government Code, Sections 37202 and 37208 and
other applicable laws, the City Clerk is authorized to prepare a semi-monthly payroll
and to issue checks against the Salary and Wage Fund for the payment Of all salaries
and wages to the several officers and employees of the City as such salaries and wages
are authorized by a duly approVed City Buhget or otherwise by the City Council.
Section 2: Section 2-31.of the Saratoga City Code i~ hereby amended to read
· 'as follows:
Section 2-31. Date of Payment of City Payroll; Certification~ .Approval~ etc.
of Payroll Generally·
Payment of the payroli0fcity officers and employees shall be made
on the fifteenth ~¢ thirtieth (or thirty-first)days of each month, after certification
as set forth in this section. 'The head of each City department shall certify and
approve the respective departmental paySell or attendance record for employees of the
respective department prior to the fifteenth and thirtieth (or thirty-first) day of
each month,'and shall present the same to the City Clerk who shall thereupon certify
and approve such payrolls and issue checks in payment therefore against the Salary
and Wage Fund.
Section 3: Section 2-32 of the Saratoga City Code is h~reby amended to read as
follows:
Section 2-32. Payroll Warrants; Warrants in Payment of Budgeted Demands;~Approval
Payroll warrants need not be auditedI by the C~fy'~6h'Hc~i~!~rior to'
payment. Payro~ shall be presented to the City council for ratification and approval
at the first meeting after delivery of the· payroll warrants.
Section 4: If any section, subsectiqn, sentence, clause o~ phrase ~f this
ordinance is for any reason held by a court of competent jurisdiction
to be invalid, such decision shall not affect the validity pf the remaining portions of
this ordinance. The City Council of th~ City of Saratoga hereby declares that it would
have passed this ordinance and each section, subsection, sentence, clause and phrase
thereof, i~re~pective ofthe fact that any one or more sections, subsections, sentences,
clauses or phrases be held invalid or unconstitutional.
'The above and foregoing ordinance was regularly introduced, and after the waiting
time required by law was thereafter p~ssed and a~opted by the City Council of the City
.of Saratoga at a regular meetihg of said Council held on the 20th day of November. ,
1974, by the following vote:
