AN ORDINANCE OF THE CITY OF SARATOGA AMENDING
CHAPTER 9 OF THE SARATOGA CITY CODE AND ESTABLISH-
ING AND/OR REESTABLISHING CERTAIN PUBLIC STREETS
AND PORTION OF PUBLIC STREETS IN 25 M.P.H. AND
35 M.P.H. SPEED ZONES.
The City Council of the City of Saratoga does hereby
ordain as follows:
Section 1: Based upon an engineering and traffic survey
conduct'ed on or about January 22, 1974 as to Fruitvale .Avenue,
and on or about May 17, 1974 as to Allendale Avenue, ~hd .this
Council finding that the hereinafter set forth speed limits are
justified thereby, Section 9-51 of the Saratoga City Code,
relating tomotor'vehicles and traffic, is hereby amended by
adding the following ,streets or portions of streets to the
following subsections thereof, establishing certain prime facie
speed limit.s thereon as follows:
There is hereby added to Subsection (a) of-Section 9-51
(2~,.m.p.hl) the following portions of streets:TM

prima facie limitin accord
with, and at the time specified
~ by, and in the manner, as pro-
vided in California Vehicle
Code Section 22352(b)(2).
Section 2: This Council hereby finds and determines that
the hereinabove set forth prime facie limits arejustified by the
above-referred to engineering and traffic surveys, and are reason-
able and safe and are hereby found to'be most appropriate to
facilitate the orderly movement of traffic; this Council further
finds that a limit of 65 or 55 m.p.h. is more than is reasonable
and safe upon any of the abov~-descr!ibed portions of streets;
that (as to those portions of streets for which a prima facie
limit in excess of 25 m.p.h. is established) a speed greater
than 25 m.p.h. would facilitate the orderly movement o~ vehicular
traffic and would be reasonable and safe, at the primaL facie
limits as hereinabove set forth in Section 1 hereof.
Section 3: If any section, subsection, sentence, clause
or phrase of this ordinance is for any reason held by a court
of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remaining portions of this ordi-
nance. The City Council of the City of Saratoga hereby declares
that it would have passed this ordinance and each section, sub-
section, sentence, clause and phrase thereof, irrespective of
the fact that any one or more sectionS, subsections, sentences,
clauses or phrases be held invalid or unconstitutional.
This ordinance was regularly introduced and after the
waiting time required by law was thereafter passed and adopted
