AN ORDINANCE OF THE CITY OF SARATOGA AMENDING
CHAPTER 9 OF THE SARATOGA CITY CODE AND ESTABLISH-
ING ANDTOR RE-ESTABLISHING CERTAIN PUBLIC STREETS
AND PORTION OF PUBLIC STREETS IN 25 M.P.H. AND
35 M.P.H. SPEED ZONES
The City Council of the City of Saratoga does hereby ordain as
follows:
SECTION I: It is hereby determined and declared, upon the basis
of an engineering .and traffic surveX dated February
21, 1975, that theI~pr.~,St~'t~"p~i~ia-faci~ 's~eed limit Of 25"mile~
per hour does not lfacili~t&~th~mos~cor~erly movement 'of vehicular=
traffic on the following specified portion of Johnson Avenue. The
following speed limit is hereby determined and declared to be the prima
facie speed limit on the following street, and Section 9-51 of the
Saratoga City Code relating to motor vehicles and traffic is hereby
amended by adding the following streets or portions of streets to the
following subsections thereof, establishing certain prima facie speed
limits thereon as fo,~lows. There is hereby added to subsection (c) of
'See'tio~ 9-51 (35 M.P.H.), 'the following portions~of street:

SECTION II: This'Council hereby finds and determines that the
hereinabove set fort~hprima facie limits .are justi-
fied by the above-referred to engineering and traffic surveys, and are
reasonable and safe and are hereby found to be most appropriate to facili-
tate the orderly movement of traffic r this Council further finds that a
limit of 65 or 55 M.P.H. is more than-is reasonable;and safe upon any of
the above-described portions of streets; that (as to those portions of
streets for which a prima facie limit in excess of 25 M.P.H, is esta-
blished) a speed greater than 25 M.P.H. would..f~a~-~ii{tate the order move-
ment of vehicular traffic and would be reasonabl~ and saf-e, at the prima
facie limits as hereinabove set forth in Section I hereof.
SECTION III: If any section, subsectioh, sentence, clause or phrase...
of this ordinance is for any reason held by a court of
competent jurisdiction to be invalid, such decision shall not affect the
validity of the remaining portions of this ordinance. The City Council of
the City of Saratoga hereby declares that it would have passed this or-
dinance and each section, sub-section, sentence, clause and phrase thereof,
irrespective of the fact that any.one or more sections, subsections, sen-
tences, clauses or phrases be held invalid or unconstitutional.
This ordinance was regularly intro~duced and after the waiting time
required by law was thereafter passed and adopted this ~]st day of
May , 1975.
