AN ORDINANCE OF THE CITY OF SARATOGA AMENDING
CHAPTER 3 OF THE SARATOGA CITY CODE, WHICH
CHAPTER IS ENTITLED "MISCELLANEOUS BUILDING
REGULATIONS" BY REPEALING SECTION 3-60.2
THEREOF
WHEREAS, heretofore onI the ls't day of December, 1976 this
Council passed and adopted Ordinance No. 38.71, amending Chapher 3
to the Saratoga City Code, relating Eo inspection 6f housing units
on resales:, and in so doingincluded-Section 3-60.2 amongst said
amendments~ which section'limited the duration of the entire chapter
to a one year period of. time, and
WHEP~AS, it is the desire of this Council, after reviewing
the' operation and effect of said Chapter 3 during the past year, to
make the basic inspection_ of housing units on resale of Chapter 3
permanent, by repealing Section 3-60.2.
NOW, THEREFORE, the 'City Council of the City of Saratoga'd0es~
hereby ordain as follows:
Section 1: Section 3-60.2 of the Saratoga City Code, which
section was added by Ordinance No. 38.71 by ~nd~the~same.is:h~eby
.repealed.
Section 2: If any Section, .~ubsection', sentence, clause or
-phrase of this ordinance is for any reason held by a court of
competent jurisdiction to be invalid, such decision shall non affect
the validity of the remaining portions of this. ordinance, The City
Council of the CiKy of-Saratoga hereby declares that it would have
passed this ordinance an~ each section, subsection, sentence, clause
and phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses or phrases be held invalid
or unconstitutional.
Section 3: This ordinance will take effect,- and be in full
force and effect, 30 days after the date of its passage.
The above and foregoing ordinance was regularly introduced
and after the waiting time ~equired by law was thereafter passed and
adopted at a regular ~eeting of the City Council of the City of
Saratoga held on the' 1 day of February, 1978, by the following
