AN ORDINANCE OF THE CITY OF SARATOGA AMENDING
CHAPTER 9 OF THE SARATOGA CITY CODE, WHICH
CHAPTER IS ENTITLED "MOTOR VEHICLES AND TRAFFIC"
BY REPEALING SECTION 9-208 THEREOF
WHEREAS, heretofore on the 1st day of December, 1976
this Council passed and adopted Ordinance No. 38.72, adding
Chapter 9 to the Saratoga City Code, relating to the regula-
tion of off-street vehicles, and in so doing included
Section 9-208 amongst said amendments, which section limited
the duration of the entire chapter to a one year period of
time, and
WHEREAS, it is the desire of this Council, after review-
ing the operation and effect of said Chapter 9 during the
past year, to make the basic off-street regulations of
Chapter 9 permanent, by repealing Section 9-208,
NOW, THEREFORE, the City Council of the City of Saratoga
does hereby ordain as follows:
Section 1: Section 9-208 of the Saratoga City Code,
which section was added by Ordinance No. 38.72, be and the
same is hereby repealed.
Section 2: If any section, subsection, sentence, clause
or phrase of this ordinance is for'any reason held by a court
of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Saratoga hereby
declares that it would have passed this ordinance and each
section, subsection, sentence, clause and phrase thereof, irrespec-
tive of the fact that any one or more sections, subsections,
sentences, clauses or phrases be held invalid or unconstituional.
Section 3: This ordinance will take effect, and be in
full for~e and effect, immediately as an emergency measure. ~
The urgency and emergency nature is that, by virtue of the
expiration date of December 31, 1977 in Section 9-208, unless
the within ordinance becomes effective immediately there may
be a gap of in excess of thirty (30) days during which the
regulations of Chapter 9 of the Saratoga City Code would not
be in force and effect, and it is necessary, and this Council
so finds, that it is necessary for the preservation of the
public health, peace, safety and welfare that there be no
such gap, and this ordinance take effect immediately.

The above and foregoing ordinance was introduced as an
urgency and emergency measure, and was thereafter passed and
adopted at a regular meeting of the City Council of the City
of Saratoga held on the 4th day of January, 1978, by the
following vote:
AYES: Councilmen Kraus; Corr, Brid~es, and Brigham
NOES: None
ABSENT: Councilman Matteoni , /~/
