AN ORDINANCE OF THE CITY OF SARATOGA
AMENDING THE SARATOGA CITY CODE BY AMENDING
A PORTION OF SECTION 8-12, RELATING
TO HEARING ON IMPOUNDMENT OF ANIMALS
The City Council of the City of Saratoga hereby ordains as follows:
Section 1: Sectign 8-12 is hereby amended to be captioned
"Hearing on Impoundment", to read as follows:
Section 8-12. Hearing on Impoundment
Whenever any animallis impounded by the poundmaste~
whether under this division or under any any other division 0f this
code the poundmaster shall use reasonable diligence to attempt to
locate the o~ner and shall notify such owne~ of the ani~al'sr~ I:%__~..~

hearing with reasonable notice to. the o~er, concerning the reason
for said impoundment. Said hearing shall be within a reasonable
time after the impoundment. In addition, the poundmaster~shall post
a notice of the impoundment in a conspicuous place at the entrance
of the City Hall, Which notigeshall contain a description of the
animal impounded, and shall set forth the fact that unless it is
reclaimed before the time specified in said notice, which time shall
not be less that three (3) days~ nor more than ten (10) days from
the posting thereof, the poundmaster will proceed to dispose of such
animal, provided that all animals taken into custody of the poundmaster
which by reason of age or disease or other infirmity are unfit for
further use, or which are dangerous to be kept impounded, shall be
destroyed by him in a h~ane manner as soon thereafter as is
conveniently possible, and in case of such destruction of suc~
animal, the poundmaster shall not be required tO give the aforesaid.

specified in the aforesaid notice and in the manner specified in
this division shall be disposed of by the poundmaster.
Section 2: If any section, sub-section, sentence, clause or
phrase of this ordinance is for any reason held by a court of
competent jurisdiction to b'e invalid, such decision shall not affect
the validity of the remaining portions of this o~dinance. The City
Council of the City of Saratoga hereby declares that it would have
passed this ordinance and each section, sub-section, sentence,
clause and phrase thereof, irrespective of the fact that any one or
more sections, sub-sections, sentences, clauses or phrases be held
invalid or unconstitutional.
Section 3: ~is ordinance shall take effect and be in full force
and effect thirty (30) days after the date of its passage and
adoption.
The above and foregoing ordinance was regularly introduQed
and after waiting time required by law was thereafter passed ~nd
adopted at a regular meeting of the City Council of the City of-
Saratoga held on the 16th da~ of February , 1977, by the following
