HomeMy WebLinkAbout38.75-1~' ~ ORDINANCE NO. 38.75-1 AN ORDINANCE OF THE CITY OF SARATOGA REAFFIRM- ING AND REESTABLISHING PRIMA FACIE SPEED LIMITS FOR MOTOR VEHICLES ON PORTIONS OF COX AVENUE, PROSPECT ROAD, ALLENDALE AVENUE AND QUITO ROAD, TOGETHER WITH ADDITIONAL FINDINGS IN SUPPORT THEREOF. The City Council of the City of Saratoga does hereby ordain as follows: WHEREAS, heretofore on the 2nd day of March , 1977 this Council passed and adopted Ordinance 38.75 setting and establishing prtma facie speed limits for a number of streets in this City, based upon an engineering and traffic survey conducted within the last five years, and WHEREAS, on certain portions of certain streets set forth in said Ordinance, which streets and portions thereof and the prima facie limits therefor are hereinafter set forth herein, said limits were based upon and found to be justified by, although not identical with, that certain engineering and traffic survey conducted and completed by City on or about the 21st day of October, 1976, and WHEREAS, it is the desire of this Council to make further and additional findings in support of that action, NOW, THEREFORE, the City Council of the City of Saratoga does hereby ordain as follows: Section 1: Reference is hereby made to the following prima facie speed limits for the following portions of streets in this City, which were heretofore adopted by Ordinance 38.75: Prima Facie Description of Portion t. Rate Name of Street of Street Affected 25 m.p.h. Cox Avenue From Saratoga Avenue to Quito Road 35 m.p.h. Prospect Road From its intersection with the easterly city limit line, to its intersection with Stelling Road, exclusive of such portions of said street as are contiguous to any school building or grounds -1o Prima Facie Description of Portion Rate Name of Street of Street Affected which shall still be subject to a 25 m.p.h. prima facie limit in accord with, and at the times specified by, and in the manner, as provided in California Vehicle Code Section 22352(b) (2) 25 m.p.h. Allendale Avenue From its intersection with Qulto Road, westerly to a point 150 ft. + westerly of Chest[r Avenue 25 m.p.h. Quito Road From its intersection with Pollard Road, southerly to its intersection with Bicknell Road The above set forth prima facie limits are hereby reestablished and reaffirmed by this Ordinance. This Council hereby finds that each and every one of said prima facie limits is justified by the engineering and traffic survey of October 21, 1976. Engineering and traffic data substantiating the 25 m.p.h. prima facie limit on the portion of Cox Avenue above-described includes the intense commercial, professional and pre-school development in the area which development generates significant cross-traffic volumes, and proximity to E1 Quito Park; Engineering and traffic data substantiating the 35 m.p.h. prima facie limit on the portion of Prospect Road above-described includes significant pedestrian volume generated by the several schools and churches in the area; Engineering and traffic data substantiating the 25 m.p.h. prima facie limit for the portion of Allendale Avenue above-described is the narrowness of the road and the lack of either improved or unimproved shoulders and the intense pedestrian and bicycle volumes, coupled with the many obscured driveways which would not be readily apparent to drivers in the area; .~ Engineering and traffic data substantiating the 25 m.p.h. prima facie limit on the above portion of Quito Road includes the more than significant speed-related accident history, which 'is 9.87 accidents per million vehicle miles as compared~ with a range of between 3.80 and 5.26 for similar roads .~i ~ -2- Section 2: The above and foregoing specific findings are not'intended to be all-inclusive, nor are they intended in any way to restrict the ultimate findings of this Council that each of the foregoing prima facie limits for the fore- going sections of public streets are justified by the heroino above referred to engineering and traffic survey. Section 3: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Saratoga hereby declares that it'would have passed this Ordinance and each section, subsect ion, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, sub- sections, sentences, clauses or phrases be held invalid or unconstitutional. Section 4: This Ordinance will take effect and be in full forC~ and effect thirty (30) days from and after the date of its passage and adoption.
