AN ORDINANCE OF THE CITY OF SARATOGA'AMENDING CHAPTER 3
OF THE SARATOGA CITY CODE, WHICH CHAPTER IS CAPTIONED
"BUILDING REGULATIONS" BY ADDING PARAGRAPHS TO SECTION
906 OF THE UNIFORM PLUMBING CODE RELATING TO SPECIAL
FIXTURES AND SPECIALTIES, AND BY ADDING SECTION 5407
TO THE UNIFORM BUILDING CODE RELATING TO SUPERSEDING
FEDERAL REGULATIONS RE CERTAIN GLASS AND GLAZING
The City Council of the City of Saratoga does hereby
ordain as follows:
Section 1: The City of Saratoga, like many other cities
in the State of California, is experiencing a severe drought.
On the basis thereof it is hereby found that the modifications '
or changes to the Uniform Plumbing Code set forth in Section 2
below are needed because of local conditions, pursuant to
Health & Safety Code Section 17958.5 and other applicable
laws and regulations.
Section 2: Section 3-17.8 is hereby added to Chapter 3
of the Saratoga City Code to read as follows:
Section 3-17.8: Section 906 of the Uniform Plumbing
Code iS hereb amended by adding thereto the following
additional sZ~paragraphs:
(f) Water closets (toilets) installed in any
building within the City shall be equipped with water
reservoirs that limit the water.used to no~ more than
three and one-half (3-1/2) gallons per f~ush. On
water closets without reservoirs, the flushing device
shall limit the flow to three and one-half (3-1/2)
gallons per flush.
EXCEPTION: Excessively long sewer laterals or
other unforeseen circumstances that would impair the
proper removal of wastes need not comply.
(g) Shower heads shall be designed to allow a
flow of not more than four (4) gallons per minute.
(h) Faucet aerators shall be designed to introduce
air into the water flow reducing the water usage to
-three and one-half (3-1/2) gallons per minute.
Section 3: Section 3-9.15 is hereby. added to Chapter 3
of the Saratoga City Code to read as follows:
Section 3-9.15: Section 5407 is hereby added to
the Uniform Building Code relating to glass and glazing:
Section 5407: Anything to the contrary in
this Code notwithstanding, all doors, including storm
doors and d _
combination doors, bathtub oors and enclosures,
shower doors and enclosures, patio-type sliding glass
doors and glazed panels, which architectural products
incorporate glazing materials, and all the glass and

glazing thereof, shall conform with the provisions
of the Federal Safety Standards for Architectural
Glazing Materials (16 CFR Part 1201 as amended;
42 FR 1428) insofar as the same may be applicable.
This ection is adopted to conform with the provisions
of Section 26(a) of the Consumer Products Safety Act.
Section 4: This ordinance is enacted as an urgency
and emergency measure to take effect immediately upon passage
and adoption. The facts constituting 'the urgency are that
it is for the general welfare, health and public safety of
the community that water be conserved in this period of drought,
and at all times; and in relation to the Federal Glass and
Glazing Standards, the fact that said standards have been
enacted and are in full force and effect and take precedence
over State, Municipal and local requirements otherwise
covering such matters.
The within and foregoing Ordinance was regularly
introduced as an emergency measure, the same being read in
full, and was thereafter passed and adopted by the City Council
of the City of Saratoga at a regular meeting thereof held on
the 7th day of September , 1977 by the following vote:
