AN ORDINANCE OF THE CITY OF SARATOGA
MODIFYING THE PROCEDURE PRESCRIBING TIME AND METHOD OF
PAYMENT OF PAYROLL AND REIMBURSEmeNT OF FUND
City Council of the City of Saratoga does hereby ordain as follows:
SECTION 1: Section 2-30 of the Saratoga City Code is hereby amended to
read as follows:
Section 2-30. Same Issuance of Payroll Checks.
Pursuant to the State Government Code, Sections 37202 and 37208 and
other applicable laws, the City Clerk is authorized to prepare a bi-weekly
payroll and to issue checks against the salary and wage fund for the payment
of all salaries and wages to the several officers and employees of the City
as such salaries and wages are authorized by a duly approved City budget
or otherwise by the City Council.
SECTION ~: Section 2-31 of the Saratoga City Code is hereby amended to
read as follows:
Section 2-31.~?~Date of Payment Of City Payroll; Certification, Approval,
etc. of Payroll Generally.
Payment of the payroll of City officers and employees shall be made
every other Thursday, beginning January 12, 1978, after certification as
setforth in this section. The Head of each City Department shall certify and
approve the respective departmental payroll or attendance record for employees
of the respective departments prior to the designated dates for the ~ssuanc~eT.
of the payroll, and shall present the same to the City Clerk who shall there-
upon certify and approve such payrolls and issue checks in payment therefor
a~ainst the salary and wage fund.
SECTION 3: Unless otherwise indicated, the modifications contained in
this ordinance shall be effective as of the 1st day of January 1978.
SECTION 4: Section 2.31.1 is hereby added to the Saratoga City Code to
be captioned and read as follows:
Section 2~31.1. Time and!Method of Paying Salaries and Wages.
From and after this date, the time and method of paying salaries and
wages of officers and employees may be modified or changed by resolution
without amendment of the foregoing sections of this Code.
SECTION 5: If any section, subsection, sentence, clause or phrase of this
ordinance is for any reason held by a court of competent jurisdiction to be
invalid ~uch decision shall not affect the validity of the remaining portions
of this ordinance. City Council City of Saratoga hereby declares that it
woultd have passed this ordinance and each section, subsection, sentence,
cladse and phrase thereof irrespective of the fact that any one or more
sections, subsections, sentences, clauses or phrases be held invalid or
unconstitutional.
The above and foregoing ordinance was regularly introduced, and after
the waiting time required by law, was thereafter passed and adopted by the
City Council of the City of Saratoga at a regular meeting df the City Council
held on the 21 day of December, 1977, by the following v~te:
