HomeMy WebLinkAbout38.96 ORDINANCE ~0, 38, 96 AN ORDIN~LNCE OF TH~ CITy OF SARATOGA ADDING SECTION 10-6 TO CFj~PT~ l00~ TH~ SARATOG~ CITY CODE RELATING TO BLOCKING OF WAYS OPEN TO THE PUBLIC The City Council of the City of Saratoga does hereby ordain as follow's: Section 1: The Saratoga City Code is hereby amended by adding Section 10-6 to Chapter 10 thereof, to read as follows: Section 10-6: No person shall loiter, stand or sit in or upon any walkway, mall, parkway, plaza, parking lot, or other property, whether in public ownership or in private ownership but open to the use of the general public, which property is designed to be used by meanhers of the public for pedestrian or vehicular passage, so as to in any manner hinder or obstruct the free passage therein or thereon of persons or vehicles passing along the same, or so as to in any manner annoy or molest persons passing along the same. This section is intended to be in addition to the prohibitions of Sections 10-7 and 13-3 of this Code. Section 2: If any section, subsection, sentence, clause 'br'phr'a~"~f'E]Yi-~rd~n'dYl'ce~i-s' 'for' nny rea-son-~he-~d-by-a -eourt of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Saratoga hereby declares that i~ would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be held invalid or unconstitdtiohal. Section 3: This ordinance shall take effect and be in full force and effect thirty (30) days from and after the date of its passage and adoption.
