TflB CITY SA ATOeA m AB m O RES me IONS The City Council of the City of Saratoga h~.r.eby ordains as follows: SECTION 1: Findings and determinations~,= The City Council finds and determines as follows: (a) Local reservoir water storage in and around Santa Clara County is at an all time low, as determined by the Santa Clara Valley, Ware~ Dis{~!~'t'; : (b) Groundwater production must remain in relative balance with recharge from year to year in order to prevent overdrafting of the aquifers, with a~beiated loss of long term storage and possible infrastructure damage, ~y!th"eostly dam~'to the City and possible salt water intrusion. (c) Santa Clara County is entering its third ye~of below average rainfall, and there are insufficient local and imported water resources to meet the current and anticipated demand. ' (d) The United States Bureau of Reclamation has announced that it will cut the Santa Clara Valley Water District's water allotment by twenty percent. (e) The State Department of Water Resources has announced it has cut the Santa Clara Valley Water District's water allotment by ten percent. (f) The City and County of San Francisco's Hetch Hetchy Project has indicated they wiH be requesting the cities they serve to reduce water consumption by twentyZ'~ five to thirty-five percent. (g) The Santa Clara Valley Water District.~nd the.~.~n:~gs~ Water Company anticipate a need for an area-wide effort to reduce,~ater c~ffiptibn by twenty-five percent. (h) There is an urgent need to initiate water conservation measures immediately to reduce the current level of Water eonsumpt~::~nd provide fO~'the more efficient utilization of se~ee water resoU~.9~ SECTION 2: Restrictions on water use (a) The following restrictions shall app,,,l~ throughout the City until such time as a declaration is officially made by the Sa/{~!:lClar}{~alley ware District that a- drought condition no longer exists within Santa ~iilra Cfi~.~L=: ~ ~' ' Rev. 3/24/89 -1- (1) No activities resulting in water waste shall be allowed~ including, but not limited to, flooding or runoff on sidewalks, streets or gutters. (2) No use of water for cleaning of sidewalks~ driveways~ patios, parking lots or other hard surface areas shall be allowed. (3) No use of water through a hose for washing cars, buses, boats, trailers or other vehicles shall be allowed without a positive automatic shut-down valve on the outlet end of the hose. (4) No decorative fountain or other form or decorative water display shall be operated. (5) No water shall be used for construction purposes, such as consolidation of back-filL (6) No water waste due to a broken or defective plumbing, sprinkler or irrigation system shall be allowed. (7) No exterior landscape watering shall be allowed during any day between the hours of 8:00 a.m. and~8:00 p.m. (8) No water shall be served by any restaurant to its customers, except upon specific request by the customer. (9) No hydrant flushing shall be permitted, except where required for public health or safety. (10) No building, grading or plumbing permits shall be issued for the drilling, installation, connection or operation of a new water well or the reactivation of any existing well not in use as of the date this Ordinance is adopted. (b) The violation of any restriction set forth in Paragraph (a) of this Section is hereby declared to be unlawful and shall constitute an infraction for which a fine of $100 shall be imposed for the first conviction, a fine of $200 shall be imposed for a second conviction within a period of one year, and a fine of $500 shall be imposed for a third or any subsequent conviction within a period of one year. SECTION 3: Water conservation devices A new Section 16-75.030 is added to Article 16-75 of the Saratoga City Code to read as follows: "S16-75,030 Water conservation devices (a) All newly construeted buildings and irrigation systems shall be equipped with water conservation plumbing fixtures, as specified or approved by the building official. (b) All newly installed irrigation systems for exterior landscaping shall be equipped with automatic timers and water sensors, as specified or approved by the building official. Rev. 3/24/89 -2- (c) All n~wly constructed or remodeled non-residential buildings shall be equipped with automatic shutoffs for plumbing fixtures, as specified or approved by the building official. (d) No single pass cooling processes shall be utilized in any new construction." SECTION 4: Severability If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. SECTION 5: Effective date This Ordinance is an urgency ordinance and shall become effective immediately upon adoption.
