AN ORDiNANCE OF THE CITY COUNCIL OF THE
CITY OF SARATOGA CONSOLIDATING THE GENERAL
MUNICIPAL ELECTION OF THE CITY OF SARATOGA
WITH THE NOVEMBER 1996 STATEWIDE GENERAL ELECTION
AND IN NOVEMBER OF EACH EVEN NUMBERED YEAR THEREAFTER
The City Council of the City of Saratoga hereby ordains as
follows:
WHEREAS, the City's General Municipal E~ection is limited by
state law to being held on: (1) the second Tuesday in April of
even-numbered years; (2) the first Tuesday after the first Monday
in March of odd-numbered years; (3) the same day as the statewide
primary election; (4) the same day as the statewide general
election; (5) or the same day as school district elections; and
WHEREAS, by Ordinance No. 67, enacted February 17, 1982, the
City Council consolidated the City's General Municipal Election
with the day of the statewide primary election in June of each
even Dumbered year; and
WHEREAS, in 1993, Assembly Bill 2196 was signed into law
consolidating the statewide primary election in 1996 with the day
of the presidential primary election held in that year, on the
fourth Tuesday in March; and
WHEREAS, Assembly Bill 2196 is operative only until January
1, 1998, at which time the day of the statewide primary election
returns to June of each even numbered year, unless the statute
consolidating the statewide and presidential primaries is
reenacted; and
WHEREAS, in order to avoid uncertainty as to the date of
future General Municipal Elections, to encourage maximum voter
participation, and to continue the cost savings derived from
consolidated elections, the City Council of the City of Saratoga
deems it to be in the best interest of the citizens to
consolidate the General Municipal Election with the statewide
general election.
NOW, THEREFORE, BE IT ORDAINED that the General Municipal
Elections of the City of Saratoga shall be consolidated with the
day of the statewide general election of November of 1996 and in
November of each even numbered year thereafter.
BE IT FURTHER ORDAINED that the City Clerk is directed,
within thirty (30) days of the operative date of this Ordinance,

to cause a notice to be mailed to all registered voters informing
the voters of the change in the date of the General Municipal
Election, and that as a result of the change in the date of the
General Municipal Election, City Councilmembers' terms in office
will be extended and that no terms will be decreased.
BE IT FURTHER ORDAINED that the City Clerk is directed to
transmit a copy of this Ordinance, upon its adoption, to the
Board of Supervisors of Santa Clara County for its approval.
This ordinance shall be published by the City of Saratoga as
required by law.
Section 2: This Ordinance shall be in full force and effect
thirty (30) days after its passage and adoption.
The above and foregoing Ordinance was regularly
introduced and after the waiting time required by law, was
thereafter passed and adopted at a regular meeting of the City
Council of Saratoga held on the 7th day of September ,
1994, by the following vote.
