HomeMy WebLinkAboutNS-3.16 ORDINANCE NO, NS-3,16 AN ORDINANCE AMENDING ORDINANCE NS-3, THE ZONING ORDINANCE OF THE CITY OF SARATOGA, BY AMENDING ARTICLE 7 THEREOF, CHANGING C-S COMMERCIAL SERVICE DISTRICTS TO C-V VISITOR COMMERCIAL DISTRICTS, PROVIDING NEW AND DIFFERENT USES AND REGULATIONS THEREFOR, AND BY AMENDING SECTIONS 1.6 AND 10.5 (a) OF SAID ORDINANCE The City Council of the City of Saratoga does hereby ordain as follows: Sec~iop h Section 1.6 of Ordinance NS-3 is hereby amended by changing the category C-S commercial service zoning district, to C-V, visitor conmercial. Sectipn 2: Section 7.2 (c) of Ordinance NS-3, .relating to permitted uses, is hereby amended .to read as follows: co C-V VISITOR COMMERCIAL Antique Stores (without:Ohtside display of merchandise) ' Apparel and apparel accessory stores Art and artists* supply stores Art galeties and stores selling objects of art. Art and crafts schools and colleges Bakeries Banks and Savings and Loan Associations Beauty salons and personal improvement studios Book Stores Candy stores and ice cream stores including soda fountains China and glassware stores Clothing specialty stores Cutlery shops Delicatessen stores Florist shops Food' stores limited to 12,000 square feet incldding storage area Fur shops Furniture Special~y Store .Gift shops and greeting card shops Hobby shops Interior decorating shops including carpets and draperies Jewelry stores Leather goods and Luggage stores Liquor stores Millinery shops Music stores Pharmacy Professional - Administrative Offices Retail sales incidental to permitted uses Sporting goods shops Stationary stores Tailor and dressmaking sh6ps .... Typewriter repair shops" Yarh and yardage shops -1- S~ti.on 3: Section 7.3 (c½; of Ordinance NS-3, relating 'to conditional uses, is hereby amended to read as follows: c. C-V Visitor Commercial Barber shops Business offices (real estate) Clubs and lodges Coffee'shops Data Processing Electrical appliance service shops Laboratories Mortuaries, cremat9riums, mausoleums Motels Publlc buildings and grounds Public utility and public service stations, power stations, drainage ways and structurest storage tanks and transmission lines found by.the City Planning Commission to be necessary for the public health, safety or welfare. Publishing and printing houses Radio and television shops Recreational centers (privately.operated within a building) Restaurants (conducted completely within a building) Telephone an~wering service Theaters (within a completely enclosed building) Veterinarians offices and small animal hospitals, including short-term boarding of animals and incidental care such as bathing and trimming ACcessory structures and uses located on the!same .site as a conditional use ~e~tion 4: Section 7,4 of Ordinance NS-3, entitled "Access" is hereby amended to read as follows: Section 7,4 ACCESS In a C-V district, where a site adjoine§ a State Highway vehicular access point, off-street parking and loading facilities shall be provided as prescribed by the Director of Public Works, The City shall have the right to require re-alignment and interconnection Of parking access roads and highway access points when necessary to promote safety and ease of traffic circula- tion. Sec,t,ion 5: The first sentence of Section 7~5.of Ordinance NS-3 entitled "Screening and Landscaping; Fences, Walls and Hedges" is hereby mended to read as follows: In a C-N District an area not less than 5 feet deep, and in a C-V District an area of not less than 10 feet deep, adjoining all property lines that abut on a street, shall be rlandscaped with plant materials and~br improved with sidewalks or pathways as required by the Planning Commission. All shrubs and planting materials shall be pe.rmanently maintained by the owner. -2- Section 6: All reference to C-S District in the second paragraph of Section 7.5 of Ordinance NS-3, is hereby changed to C-V District; all reference to C-S District in Section 7.6 of Ordinance NS-3s is herebycd_~_l~.~e~'~.~ Section 7: The third paragraph of Section 7.7 of Ordinance NS-3s which relates to the regula- tions in a C-S District in relation to site area frontage width and depth of sites is and are hereby repealed; the first sentence of said Section 7,7 is hereby amended to read as follows: In a C-N and.'C,V District, the following regula- tions shall apply:' Section 8: The third sentence of Section 7,8 of Ordinance NS-3 is hereby amended to read as follows: In a C-V Districts the maximum site area covered by structures shall be 602, Section 9: The third and last sentence of Section 7.9 of Ordinance NS-3s which section is entitled "Front Yard" is hereby amended to read as follows: In a C-V Districts the minimum front yard shall be 10 feets except that on a site adjoining an As Rs or P-A District and irontint on the same street or on a site across the street from an As Rs or P-A Districts ~heminimum front;y'a~'d~' shall be 15 feet; and furthers where the site ~t~ on the Saratoga-Sunn ale Road, the fro.t ' _ / sidewalk, landscaping ~md par~ing spaces mid p~king access roads shall be developed within the set-back limits as more particularly set forth hereto and incorporated herein by Section 10: Section 7,10 of Ordinapce NS-3s entitled "Side'Yards-and Rear Yards" is hereby amended by eliminating all re~erence .therein~rto C-S Districts and in lieu ~hereofs adding the following regulations: In a C-V Districts ehe following regulations shall apply: a, The minimum side yards bhall be 10 feet. One foot shall be added to a side yard for each 2 feet of height or fraction thereof by which a portion of a structure within 30. feet of the nearest ~ide p~operty line exceeds .14 feet in height, On a comer lot the minimum side. yard ~dJoining the street shall be 20 feet, One foot shall be added to a side yard for each 2 feet of height or fraction thereof by which a portion of a structure within 30 feet of the rear property line exceeds 14 feet in height. c. The minimum rear yard shall be 30 feet. One foot shall be added to the minimum rear yard for each 2 feet of height or fraction thereof by which a portion of structure within 60 feet of the rear property line exceeds 14 feet in heights' Section 11: The third sentence of Section 7.11 of Ordinance NS-3, which section is entitled "Heights of Structures", is hereby amended to read as follows: In the C-V District, no structure shall exceed 20 feet in height. Section 12: This Council hereby finds and determines that harmony of design, of architectural features and of landscaping preserve and promulgate the natural beauty of this City, and creat and establish economic benefit therefor, protecting the economic interest of the property owner, and further finds that inharmonious architecture and design have an adverse effect upon the economy of this City: by reason of the foregoing, Sectipn ~15 of Ordinance NS-3, entitled "Design Review", is hereby amended to read as follows: - (a) All uses ~hall be subject to design review as prescribed in Article 13. (b) In a C-V District, in addition to the regulations already provided by Article 13 hereof, the follow- ing additional standards shall be applicable on design review: 1. Access D.r.ive A continuous access drive to parking and load- ing areas for all properties between designated a~cess points to be arterials shall be located between the arterial and the front of the buildings. 2, More Than One Buildin~ Where there is more than one building or structure in a proposed development the architectural features and landscaping of all the buildings shall be harmonious. These features specifically include roofs, elevations, architectural style, surfacing materials and fenestration. 3, Signs Where there is more than one sign in a proposed development they shall have a common overEll design and locational positions and be harmonious in appearance, ,. 4, LandscaDin~ The typical spread of t~ees within a five-~ear growth pariod shall cover at least 15 per cent of the lot area and shall be clustered in natural appearing groups (instead of being placed in rows or regularly spaced), -4- 5. Covere,d }~alkways A covering for walkways adjacent to the-front or sides of stores shall be provided 6. ~uildin~ Mater,ial and Colors Colors of wall and roofing materials shall blend with the natural ].andscape and be non- reflective. 7. Roofs Roofing materials shall be woo~ shingles, wood shakes, tile, or other materisis such as com- position as approved by the City Plannin~ Commission. No equipment (e.g., for heating, cooling, venting, or servicing buildings) shall be located upon a roof unless it is appropriately screened. Section 13: Secion 10.5 of Ordinance NS-3, which section is entitled "Signs in Commercial Districts", is hereby amended by amending Subparagraph (a) thereof, to read as follows: a, An identification sign or signs pertaining to a use conducted on the site, not more than one- half square foot in area for each font of width of the front elevation of the building and the side elevation on the street side of a corner lot, or not more than one-fourth square foot in area for each foot of street frontage of the site. In a C~_N, 'C-C, or C-V District, the aggregate area of all siFns identifying a parti- cular use shall not exceed 40 square feet. In addition, directionsl signs for off-street ,_park~s and l~ad~ing, each~not too_r.? ,th_b..~_~~ .pSiere Section 14: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held by a court of competent Jurisdiction to be invalid, such decision shall not affect the validity of the rem~inin~ provisions of this ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and prhase thereof, irrespective of the fact that any'one or more sections, subsections~ sentences, clauses or phrases be held invalid or ,,unconstituational.
