AN ORDINANCE AMENDING ORDINANCE NS-3,
THE ZONING ORDINANCE OF THE CITY OF
SARATOGA, BY ADDING ARTICLE 22 THERETO,
ENTITLED "PUBLIC UTILITIES", AND
REQUIRING ALL PUBLIC UTILITIES TO
BE INSTALLED UNDERGROUND IN ALL ZONING
DISTRICTS IN THE CITY.
The City Council of the City of Saratoga hereby ordains as follows:
Section 1: Article 22 is hereby added to Ordinance NS-3 of the'
City of Saratoga, which Article and its sections and
sub-sections, shall read as follows:
ARTICLE 22 PUBLIC UTILITIES
Section 22.1 PUBLIC UTILITIES UNDERGROUND: All electric lines and
communication lines,
and appurtenances, including all public utility systems and services
facilities therefor, and also all telegraph and CATV distribution or
transmission facilities, shall hereafter be located and installed
underground on all lands and zoning districts within the City limits
of the City of Saratoga, except ashereinafter specifically permitted.
No person shall directly or indirectly erect, construct, fabricate
or install any tower, pole or similar structure, for the purpose of
operating or maintaining any overhead electirc lines and/or any over-
head communication line or lines, or any appurtenant structure or
part thereof, except as follows:
(1) Existing overhead electric and communication lines, poles, and
transformers, may be replaced. overhead when required because of deterior-
ation, or because of damage by fire,'wind, falling trees, or other acci-
dental means.
(2) Temporary electric and corm~unication lines, poles, and trans-
formers to~se~ve~cp~st~dctionprojects or emergency situations for per-
iods not to exceed six (6) months, unless such time is extended by the
City Administrator.
(3) Overhead electric lines, communication lines, poles and tra~s-
formers~eplaced at the same location with facilities of greater capacity ~
'~where such facilities are not already included in an existing or immediatel~
i pending ugderground! utility district.
(4) Pad-mounted transformers, service pedestals, meter cabinets, surface
mounted switches, and concealed ducts, so long as they are used soley in
connection with, and as appurtenances to, an underground distribution system
?~ f~or facilities.
(5) Poles supporting electric transmission lines and the electric
transmission lines supported by such poles, where the voltage carried
by such lines is more than 34.5KV.
(6) Poles supporting street lights, and the electric lines within said poles.
(7) Overhead service drops to structures served by at least one existing
overhead service drop provided that such service drop requires installation
of no additional poles, and is not more than 500 feet in length,[
Section 22.2 PUBLIC UTILITIES UNDERGROUND - PROHIBITIONS:
No use shall be made of any land, building or structure~in the
City of Saratoga, or in any zoning district or area thereof,
for any electric lines, or cormnunication lines, or appurtenances, except as
hereinabove set forth in the preceding section.
Section 22.3 PUBLIC UTILITIES UNDERGROUND - VARIANCES:
The City Planning Commission is emplowered to grant
variances to the above set forth regulations and pro-
hibitions, in accord with Article' 17 of this ordinance.
Section 2: Ordinance 3E-6and Ordinance 3E-6.1 are hereby superseded
and repealed as of the effective date of this ordinance.
Section 3: Ifany section, $ubsection,.sentence, clause or phrase or
this ordinance is for any reason held by a court of competent
jurisdiction to be invalid, such decisionshall not affect the validity of
the remaining portions of this ordinance. The City Council of the City of
Saratoga hereby declares that it would have passed this ordinance and each
section,.subsection, sentence,.clause and phrase thereof, irrespective of
the fact that any one or more sections, subsections, sentences, clauses or
phases be held invalid or unconsti'tutional.
Section 4: This ordinance shall take effect and be in full force and effect
thirty (30) days after the date of its passage and adoption.
The above and foregoing ordinance, after public hearing held thereon by
the Planning Commission of the City of Saratoga, was thereafter introduced and
a public hearing held thereon by the City Council thereof~ and was thereafter
passed and adopted this 16th day of April, 1969, by the following vote:
