AN ORDINANCE OF THE CITY OF SARATOGA AMENDING
ORDINANCE NS-3, THE ZONING ORDINANCE, BY ADDING,
CERTAIN DEFINITIONS, DELETING MULTI-FAMILY USES,
FROM P-A ZONES, ADDING PROVISIONS FOR OPTIONAL
DEDICATION OF COMMON GREENS IN P-C ZONES, AND
EXPANDING DEFINITION OF TRAILERS TO INCLUDE CAMPERS
The City Council of the City of Saratoga does hereby ordain
as follows:
Sec~i6n 1: The following words and their definitions are
hereby added to Section 1.5 of Ordinance NS-3
which section is entitled "Definitions", to be inserted therein
in proper alphabetic~aI sequence:
1-1. DUPLEX - A dwelling consisting of two
separate dwelling units. -~
Section 2: Subsection (d) of Section 6.2 of Ordinance
NS-3, which section is captioned "Permitted
Uses", and which subsection relates to multi-family dwellings,
is hereby repealed, and multi-family dwellings are hereby deleted
from the permitted uses allowed in a P-A professional and adminis-
trative office district.
Section 3: Subsection (a) of Section 6.3 of Ordinance NS-3 ~
is captioned !'Conditional Uses" and which subsection
enumerates several conditional uses is hereby amended to add "multi- IL/
family dwellings" to the conditional uses enumerated.
Section 4: Section 4A.8 is hereby added to Article 4A of Ordinance
NS-3 of the City of Saratoga, which article is captiormd
"Planned Con~nunity District", sa~d section 4A.8 to read as follows:
4A.8 DEDICATION OF COMMON GREEN:
Where a Planned Conmmnity District is combined with
an R1-20,O00 or an R1-40,000 District, in lieu of the
owner setting aside areaa' for the cormnon benefit of
the residents, and remaining obligated for the care,
maintenance and operation of the same, he may instead
dedicate said areas, or portions thereof, to the City
for public parks or recreation uses, so long as no less
than 50% of the entire site area .is either dedicated,
or set aside for private common use, or any combination
thereof..° Each site development plan which shows any
proposed dedication for park or recreation use shall
be first submitted to the Parks and Recreation Commission
for a report and recommendation prior to action thereon
by the City Planr~ing Commission. Nothing herein contained
shall preclude the City from refusing to accept any offer
6~f dedication not deemed to be in the best interests of
the City.
Section 5: Subsection (2) of Section 3.14 of Ordinance
NS-3, relating to regulation of storage of
automobiles, boats, etc., is hereby amended to read as follows:
(2) Trailers of any kindj or make; camper units,
whether detached from or attached to the truck
or other motor vehicle for which they are
designed or customarily used, shall be considered
~ trailers f~r the purpose of this section.
Section 6: If any section, subsection, sentence, c~use
or phrase of this ordinance is for any reason
held by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remaining portions
of this ordinance. The City Council of the City of Saratoga
hereby declares that it would have passed this ordinance and
each section, subsection, sentence, clause and phrase thereof,
irrespective of the fact that any one or more sections, subsections,
sentences, c~auses or phrases be held invalid or unconstitutional.
The above and foregoing ordinance, after public hearihg held
~by [he Planning Commission of the City of Saratoga on the
°22nd .day of ~r , 196__9, was thereafter in~
and~ public hearing held thereon by the City Council of said City
on the 1st day of . April ... , 1970 , and was thereafter
passed and adopted this 1st day of .A~ril , 1970
by the following vote:
AYES: Councilmen Tyler~ Dwyer, Robbins, Smith, Sanders
NOES: None
