HomeMy WebLinkAboutNS-3.40 ORDINANCE NS-3.40 AN ORDINANCE OF THE CITY OF SARATOGA PROPOSED BY THE INITIATIVE PROCESS (ELECTIONS CODE SECTIONS 4000-4021) AMENDING THE ZONING ORDINANCE' BY PROHIBITING STADIUMS WHEREAS, THE PEOPLE OF THE CITY OF SARATOGA hereby find as follows: a. In 1967, the City of Saratoga allowed the West Valley Joint Community College District ("District" herein) ito build its .West Valley campus in the City on the condition, among others, that the campus not include a spectator-oriented sports stadium; b. In reliance on the foregoing condition, many familities purchased homes in Saratoga, seeking the unique, semi-rural atmosphere the City afforded and believing that they were safe from the types of disturbances a sports stadium would c aus e; c.. The District has now changed its plans and decided to build a stadium, which will not only be quite costly to the taxpayers of the District, but will also in general destroy the residential character of the City, particu~arly: through air pollution, noise pollution, and significantly increased traffic conge.stion; · d. The area's schools already furnish sufficient facili- ties for spectator-oriented sports and other crowd-drawing activities; and e. The people of the City desire to. prevent the building of any new stadium within the City limits, yet-still allow some flexibility for cultural events (except for rock concerts and sports events, which have historically been particularly disturbing); and -1- f. The 'following facilities should be exempt because they have historically been used in a less offensive manner: facilities at elementary and secondary (junior and senior high) schools; and facilities built by private, non-prOfit, youth-oriented organizations such as little league or the American Youth Soccer Organization, NOW, THEREFORE, the City Council of the City of Saratoga does hereby ordain as follows: 'The Saratoga Zoning Ordinance, NS-3, is amended to add the following . language: 1. Neither a stadium of any size nor any other facility with a similar use but different name shall be a permitted use in any zone. A "stadium" is a track and/or field which has any one or more of the following: permanent or portable seating (other than field-level seating for participating athletes), permanent or portable lighting, permanent or portable sound system,I press box, scoreboard, restrooms, or concession stands, and on which any inter-school events or other spectator-oriented event of any kind are held. 2. Temporary portable equipment for cultural events .(other than sports events or rock concerts) may be utilized on any track or field upon a two-thirds vote of the City Council after a duly-noticed public hearing and a finding that the particular. event will not be unduly disturbing to the City. 3. This Ordinance shall not apply to~fae~l-ities at elementary and secondary (junion and senior high) schools or facilities built by private, non-profit., youth-oriented organizations such as little league or the American Youth Soccer Organizations. 4. No part of this Ordinance may be amended or repealed except by the voters of the City of Saratoga at a regular municipal election. The above and foregoing Ordinance was submitted to the City Council of the City of Saratoga in'a petition filed with the Clerk of the legislative body, all {n accord with Elections Code Sections 4000 through 4021 of the State of California; said petition was filed with the City Clerk on the 12th day of October, 1977, and thereafter said City Clerk did duly -2~ and regularly find that said petition contained 2,544 valid signatures, in excess of the minimum number of signatures required, all inaccord with Elections qode Section 4008 a a of this State, n~l~id petition was thereafter accepted for filing; thereafter the petition ~lsubmitted to the City Council of this City at a regular meeting thereof held on the 16th day of November, 1977, and was regularly intro-' duced by a majority vote of said Council on said date; said City Council chose not to submit said proposed Ordinance to the.electorate of said City, but rather to pass and adopt the same as presented, and therefore thereafter, after the waiting time required by law after introduction, said Ordinance was duly passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 7tb day of December ., 1977 by the following vote: AYES: Councilmen Matteoni-,/,Brfdges., 'B~igham, & Kraus NOES: Councilwoman Corr ~ ABSENT: None AT~~ The above and foregoing is a true and correst copy of Ordinance ,,/5 s. 4o which has been published according to law.
