AN OI~INANCE OF THE CITY OF SARATOGA
AMENDING ARTICLE V OF CHAPTER THREL~OF
THE SARATOGA CITY CODE,.. BY AMENDING
CERTAIN SECTIONS OF CHAPTER 70 OF THE,,
UNIFORM BUILDING CODE THEREIN ADOPTED
BY REFERENCE, RELATING TO EXCAVATION
AND GRADING.l
The City Council of the City of-Saratoga does hereby
ordain as follows: ..
Section 1: Section 7021 is hereby added to Chapter 70
of the Uniform Building Code, 1964 Edition,
which Chapter 70 was adopted by reference by ordinance 38.3 of
the City of Saratoga and incorporated in the Saratoga City Code
as Article V thereof, said Section 7021 to read as follows:
Section 7021: PRIOR SITE PLAN APPROVAL OF SUBDIVISION: Where
a site
development plan has already been approved by the Building
Official under Section 10 of Part Two of the Subdivision Ordinance,
and such site development plan has been made a part of the
improvement plans and the improvement agreement and bonding
requirements of the Subdivision Ordinance, and the final
subdivision map has been approved and recorded, then
Sections 7006(c) (c) (d), 7009 (a) and 7010 hereof
shall be-deemed-to 'have been'domplied'with as' to any"
excavation or grading work done in accord with such prioriy
approved site development plan. In the event of any change
of the site development plan as to any lot, site or~parcel
from the approved site development plan, then the above
Sections shall be applicable and a separate grading plan,
grading permit, permit fee, plan check fee, and bond shall
be required therefor.
Section 2: Section 7009(b) of Chapter 70 of the above-
described Uniform Building Code, 1964
EditiOnS/is hereby amended by adding thereto the following
paragraph:
Anything to the cOnfrary hereinabove notwithstanding, no
grading permit fee shall be Charged or'collected when the
construction is under the supervision of a Civil Engineer.
Section 3: There is hereby addedto Section 3-44 of
Article VI of Chapter Three of the Saratoga
City Code, which Article was added to said Code by Ordinance
38.11 of the City of Saratoga, the following sentence:
In addition, the Building Official shall have power to waive
the preliminary soil report at the time of the submission
of the tenative subdivision map, On condition that such
preliminary soil report shall be furnished prior to the
filing of the final subdivision map.
Section 4: If any section, subsection, sentences
clause or phrase of this ordinance is for
any reason held by a court of competent 3urisdiction to be
invalid, such decision shall not affect the validity of the
remaining portions-of this ordinance. The City Council of~
the City of Saratoga hereby declares that it would have passed
this ordinance and each section,. subsection, sentence,' clause
and phrase thereof, irrespective of the fact~ that any one
or more sections, subsections, sentences, clauses or phrases
be held invalid or unconstitutional. ,
Section 5: This ordinance shall take effect and be in
full force and effect thirty days after the
date of its passage and adoption.
The above and foregoing ordinance was regularly introduced
and after the waiting time required by law 'was thereafter passed
and adopted this 15th day of February .. , 1967, by the
following Vote:
AYES: councilmen Glennon, Tyler, Hartman, Burry, Robbins
NOES: None
ABSENT: None ...... ' ' '
