ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SARATOGA REZONING CERTAIN TERRITORY
WITHIN THE CITY OF SARATOGA FOR A SINGLE PARCEL
IDENTIFIED AS APN 386-14-026
ZC-92-004; Head et al., 18805 Cox Avenue
The City Council of the City of Saratoga hereby ordains that
certain real property referred to as APN 386-14-026 is to be
rezoned from Commercial-Neighborhood (C-N) to Professional-
Administrative (P-A) Office. The reasons for such rezoning are as
follows:
1. The existing single structure office building is currently
being utilized as a professional office facility, including
professional and administrative office and dental and medical
clinic tenants. The Planning Commission reviewed and approved
the building and its intended use in 1980; and
2. In 1989, the City amended its Commercial Zoning Ordinance
requiring conditional use permits for medical clinics within
commercial zone district. This was intended to encourage
retail and service uses within the commercial districts. This
earlier zoning amendment has caused a burden on the subject
property owner, whose facility is not suited to function as a
retail establishment; and
3. The proposed General Plan and zoning amendments will be
consistent with the existing use of the property, and will
provide a compatible transition between the adjacent commer-
cial development to the south and the residential zoning dis-
tricts to the north and east.
To maintain consistency with the City's General Plan, the
General Plan land use designation will also be amended from
Commercial to Professional and Administrative.
If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held by a court of competent jurisdic-
tion to be invalid or unconstitutional, such decision shall not
affect the validity of the remaining portions of this Ordinance.
The City Council of the City of Saratoga hereby declares that it
would have passed this Ordinance and each section, subsection,
sentence, clause and phrase thereof, irrespective of the fact that
one or more sections, subsections, sentences, clauses or phrases
may be held invalid or unconstitutional.
This Ordinance shall be in full force and effect thirty (30)
days after its passage and adoption.

The above and ~oregoing Ordinance was introduced and after the
waiting time required by law, was thereafter passed and adopted at
a regular meeting by the City Council of the City of Saratoga on
the 2~di~ day of December , 1992, by the following vote:
AYES: Councilmembers Burger, Monia, Tucker and Mayor Anderson
NOES: Councilmember Kohler
