The City Council of the City of Saratoga hereby ordains as follo~-~s:
SECTION 1: Sectional District Map No. ZC-41 , attached hereto and incor-
porated herein by reference, is hereby conditionally adopted
pursuant to Section 18.11 of Ordinance MS-3 of the City of Saratoga. Upon
compliance by Franklin Homes Company . , with all conditions
attached hereto as Exhibit A and incorporated herein by reference, then and at
that time so much of the zoning map of the City of Saratoga as is in comflict
~.~th the cross-hatched area sho~,m in the above described sectional district map
shall be superceded and repealed.

the attached sectional district map from R M 400~
family residential) to RM 3000 (multiple family residential)
It shall become operative and take effect 'on and after thirty (30) days from
its date of passaSe.
This ordinance was regulaxly introduced and after the waiting time required
by law was thereafter passed and adopted this 6=h day of 'i March
1968, by the following vote:

EXHIBIT A
Ordinance NS-3-ZC-41
1. Development shall be in accor~ with: General plot arrangement shown on
Exhibits A,D, D-i, D-2, except as modified to permit compliance with
street dedication and improvement requirements, sidewalk and walkway
dedication and improvement requirements and creek dedication improvement
requirements imposed by the Planning Commission as conditions of approving
the tentative map. Said modifications shall be subject to the review
and approval of the Planning Commission and of the City Council.
2. Buildings, gates and other a~chitectural features shall conform to
architectural renderings, elevations and rooflines, as shown on
Exhibits B, B-l, B-2, B-3, D-3, D-4, and D-5, subject to final
design review by the Planning Commissions.
3. Cabana shall be constructed in accord with Exhibit C-1 and developer
shall enter into agreement with City encompassing maintenance and
operation of cabana.
4. Development shall be landscaped as shown on architectural rendering in
Exhibits B, B-l, B-2, B-3 and in accord with'final landscape plan
approved by Planning Commission and City Council encompassing preserv-
ation of major trees as shown on Exhibit E and developer shall enter
into ~greement with City whereby he agrees to maintain the landscaping
in accord with approved landscaping plan.
5. Lake shown as shaded area on Exhibits A, D, D-1 and D-2 and indicated on
Exhibits B-1 and C-1 shall be constructed as shown on said exhibits and
in accord with construction plan approved by Planning Commission and
City Council, and developer §hall enter into agreement with City
whereby he agrees to maintai~ lake and supply sufficient water to
insure maintenance of water level as shown on Exhibits A, D, D-1 and
D-2 and the lake construction plans.
6. Building Permits shall be obtained and construction shall start within
ten (10) months of Council approval of the Chamge of Zoning and construction
shall be completed within one year after b~itding permits are obtained.
