ORDINANCE AMENDING ORDINANCE NS-3- THE ZONING ORDINANCE, BY AMENDING THE ZONING ~P The City Council of the City of Saratoga hereby ordains as follows: SECTION 1: Sectional District Map No. ZC-62 , attached hereto and incorporated herein by reference, is herebylconditional adopted pursuant to Section 18.11 of Ordinance NS-3 of the City of Saratoga. Upon compliance b~ C~ orge Dav Construction Co. , with all con~tions attached hereto as Exhibit A and incorporated herein by reference, then and at that time so much of the zoning map of the City of Saratoga as is in conflict with the cross-hatched area shown in the above described sectional district ·. map shall be superceded and repealed. +~ SECTION 2: This ordinance conditionally reclassifies certain property shown on the attached sectional district map from "A" (A~ricultural) to "R-i-40,000" "P-C" (Single Family Residential Planned Community). "-', EXHIBIT "A" (1) That the entire 17.3 acres shall be developed in accord with the final site development plan submitted by the · applicant dated 24th of Jan./72 and approved by the City Planning Commission, on the _24t~day of J~i~r~l___, 1972~, file No. ~C~'1~8~~' , and that building permits shall have been issued and construction commenced on all struc- tures shown on said site development plan no later than one year from the date of adoption of this reclassification ordinance. (2) The owner shall enter into a written contract with the City of Saratoga, secured by good and sufficient bond or bonds, agreeing to be responsible for the care, maintenance and operation of all areas, buildings and facilities not dedicate to public use, but intended for the common use of!the residents of said property.
