NS3-ZC-97 AN ORDINANCE OF THE CITY OF SARATOGA REZONING CERTAIN TERRITORY WITHIN THE CITY IDENTWIED AS ASSESSORS PARCEL NUMBER 386-59-30 PROM R-l-10,000 TO RM- 3,000 The City Council of the City of Saratoga hereby ordains as follows: SECTION h The City Council finds and determines as follows: (a) An application has been filed by the owner of that certain real property located at 12764 Saratoga Avenue, Saratoga, California, identified as Assessor's Parcel Number 386-59-30, to rezone said property from R-l-10,000 to RM-3,000. (b) Following the conduct of a public hearing, on January 11, 1989, the Planning Commission of the City of Saratoga adopted Resolution No. ZC-88-002 recommending to the City Council that such zoning change be adopted. (c) The proposed rezoning is consistent with the City's General Plan and consistent with the density of development in the adjacent area. SECTION 2; The real property located at 12764 Saratoga Avenue, Saratoga, California, identified as Assessor's Parcel Number 386-59-30, is rezoned from R-I- 10,000 to RM-3,000. SECTION 3: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this Ordinance and each section,subsection, sentence, clause and phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. SECTION 4: This Ordinance shall be in full force and effect thirty days after its passage and adoption.
