AN ORDINtNCE OF THE CITY OF SARATOGA ADOPTING
BY REFERRICE CERTAIN PROVISIONS CF TITLE 5 OF
THE SANTA CLARA COUNTY ORDI~TANCE CODE, AS
AMENDED, REGULATING PRIVATE FATROLS. '~
The City Council of the City of Saratoga does hereby
ordain as follows:
SectiOn l: Article ll of Chapter i of Title 5 of the
Santa Clara County Ordinance Code, as
amended to date hereof, is hereby referred to and is
hereby adopted by reference as laws and regulations of
the City of Saratoga, and made a part hereof the same as
if fully set forth in this section.
Section 2~ Three copies of the Santa Clara County Ordinance
Code, as amended to date hereof, have hereto-
fore been filed for use and examination by the public in
the office of the City Clerk of the City of Saratoga.
Section 5: All reference in the aforesaid Article, Chapter,
and Title to the unincorporated territory in
the County of Santa Clara shall mean all of the incorporated
area of ~he City of Saratoga; all reference to the County
Counsel shall mean the City Attorney of the City of Saratoga;
all reference to the County of Santa Clara shall mean the
City of Saratoga; all reference to the Sheriff and the
Sheriff's Department shall mean the Chief of' Police and the
Police Department of the City of Saratoga, save and except
that so long as the County of Santa Clara is providing police
protection to the City of S~ratoga under contract with sa~d
City, the same shall mean and include the Sheriff and the
Sheriff's Department of the County of Santa Clara; all
reference to the Board of Supervisors shall mean the City
Council of the City of Saratoga; all reference to the Clerk
of the Board of Supervisors shall mean the Clerk of the City
of Saratoga; without limiting the foregoing, in interpreting
any of the provisions of Article ll of Title 5 of Chapter 1
of the Santa Clara County Ordinance Code, should any ambiguity
arise concerning whether the designation of a particular
officer, office or body means a county officer, office or ~
body or a city officer, office or body, then such ambiguity
shall be resolved in favor of a city officer, office or body.
~ection 4: Anything to the contrary hereinabove notwithstand-
ing, any person, firm or corporation which has a
valid and subsisting permit from the County of Santa Clara
under the provisions of Article ll, Chapter i of Title 5 of
the Santa Clara County Ordinance Code, to conduct the
business of a private patrol in the unincorporated territory
Of the County of Santa Clara, need not obtain a separate
permit under the provisions of this Ordinance, and may
conduct a private patrol within the City of Saratoga under
and by virtue of any such valid and subsisting permit from
the County of Santa Clara.

iBection 5: An~person violating any of the provisions
of this Ordinance shall be guilty of a mis-.
demeanor and upon conviction thereof shall be punishabl~
by a fine of not more than $500.00 or b~ imprisonment in
the County Jail for a period not exceeding six months or
by both such fine and imprisonment.
SectiOnS:6: If any section, subsection, sentence, clause
or phrase of this ordinance is for any reason
held by a Court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the
remaining portions of this ordinance. The City Council
of the City of Saratoga hereby declares that it would
have passed this ordinance and each section, subsection,
sentence, clause and phrase thereof, irrespective of the
fact that any one or more sections, subsections, sentences,
clauses or phrases be held invalid or unconstitutional.
This ordinance was regularly introduced, and after the
waiting time reguired by law, and a£ter public hearing held
thereon by the City Council of the City of Saratoga on the
lday of _A~, 1963, thereafter passed and adopted at
a regular meeting of said City Council held on the ~7~hday of
__~, 1963 by the following vote:
