AN ORDINANCE AMENDING ORDINANCE NS-5,
THE SUBDIVISION ORDINANCE OF THE CITY
OF SARATOGA, REQUIRING IMPROVEMENT OF
CORRIDORS, EXTENDING TIME IN WHICH TO
ACT ON TENTATIVE MAPS, AND AMENDING
DEFINITION OF SUBDIVISION
The City COuncil of the City of Saratoga hereby ordains
as follows:
Section 1: The first paragraph of Section 2.2 of Part
One of Ordinance NS-5 of the City of
Saratoga, is hereby amended to read as follows:
"Section 2.2 SUBDIVISION. "Subdivision" shall mean
· -and include any real
property, improved or unimproved, or a portion thereof, as
shown on the latest adopted County Tax Roll as a unit or as
contiguous units, which is divided for the purpose of sale,
lease, financing, or construction of improvements thereon,
whether immediate or future, by any person, firm, corporation,
partnership, associationor other entity, governmental or
otherwise, into two (2) or more parcels. It shall include ail
divisions of land which are excluded from the definition of
subdivision by the terms of Business and Professions Code
Section 11535 of the State of California, save and except that
subdivision shall not include a division of space for the purpose
of financing or leasing ~ithin an apartment b~ilding, an
industrial building, a commercial building or a trailer park,
nor shall subdivision include mineral, oil or ga~ leases."
Section 2: The first sentence of Section 2.5 of Part Two
of Or~inance NS-5 of the City of'Saratoga
is h~reby amended to read as follows:
"Action on tentative mars -- Planni.n~!Commission."
Within fifty (50) days after the filing of the.tentative
map, unless such time is extended by mutual consent of the
Planning Commission'and the subdivider, the Planning Commission
shall approve, conditionally approve, or disapprove the tentative
map and shall report such action to the subdivider or his agent.
Section 3: ~ec~ion 5.2-1 of Part Three of Ordinance NS-5
of the City of Saratoga,' is hereby amended
to read as foIlows:
"Section 5.2-1: Minimum access streets req ired." u
'Where the lot, site or subdivision of 4 or less lots
does not front on a public street or existing minimum access
street, and where the Planning Commissionallows the same to
front on a minimum access street, site approval shall be conditioned
on the improvement of such minimum access street to City
standards. This provision is intended to require not
only the construction of ~ minimum access'street where the site
does not front on any such access street or road, but also to
require the improvement of any existing sub-standard access street
or road on which the site fronts or which otherwise is used as
all or any part of the'path of the minimum access street. 'Wh~re
a lot is a-corridor lot, and fronts on~a public street by means
of a'corridor, site a~pro~l-Shall~be conditio~ed upon thd
improvement of such corriddr to,the .standards' Of ~ minimum '
access street. NeitHer aminimum access street nor a corrid6r
m~y'eonnect tO a public street at any portion of the turn-around
space of a cul-de-sac. I
Section 4: .IfTany section, subs~ctioh, sentence, clause
or ~hra~e"of this ordinande is'for any
reason held by a COurtof competent jurisdiction to be invalid,
such decision.shall not affect the validity of the remaining
portions of this Ordinance. The City Council of the City of
Saratoga hereby: declares that it would'have passed this
Ordinance and each section, subsedtion, sentence, clause and
phrase thereof, irrespective 'of the fact that any one or more
sections, sUbsections, sentences, clauses or phrases be held.
