AN ORDINANCE AMENDING ORDINANCE NS~5, THE
SUBDIVISION ORDINANCE, BY MODIFYING PROVISIONS
REGULATING HILLSIDE DEVELOPMENTS WITHIN '~R-1"
DISTRICTS AND AMENDING SECTIONS 10.3 AND 10.6
THEREOF, AND ADDING SECTION 10.7 THERETO.
The City Council of the City o~-'Saratoga does hereby orda{n as follows:
Section 1: Section 10.3 of PANT TWO of Ordinance NS-5, relating to hillside
subdivisions, is hereb~ a~ended to read as follows:
Section 10.3 STANDARDS OFHILLSIDE SITE DEVELOPMENT: Each site development
plan shall be in accord with the following development standarda:
(a) Minimum land area per dwelling unit shall net be less than
"a" as determined by the formula:

where S is the average slope of the parcel in percent determined
by the foilowing formula:

and where
I is the contour interval in feet,
I is the combined length of contour lines in-scale feet, and
A~is the gross area in acres of the parcel.
(b) The maximum~n%mber of,dwelling units permitted in a subdivision
'~ or minor land division shall be determinedby dividing the gross
land area by the required minimum land area per dwelling unit,
rounding down to next whole numberel
(c) No site shall be approved which bea~s a slope of over 40% at the

The above standards are subject to the exception of "provisions of
Sections 5.1 and 5.2 of'PART TWO hereof.
Section 2: Section I0.6 of PART TWO of Ordinance NS-~ is hereby amended by
adding thereto the following sentence: '~
Increase in lot size due to grades shall be as provided in
Section 10.3 hereof.
Section 3: Section 10.7 is hereby added to PART TWO of Ordinance NS-5, to
read as follow~:
Section 10.7.~DESIGN REVIEWsREqUIRED: Where a lot is determined to 'be a
hillside lot and' required..toh~ve a site development plan sub=
· mitted to and approved by the ~lanning Commission, then said lot
and structures to be placed thereon shall be required ~o obtain
Design Review Approval from the Planning Commission in accord
with,Article 13 of City of Saratoga Zoning Ordinance NS-3 prior
to the issuance of a building permit.
Section 4: ~f any section, subsection, sentenee, clause, or phrase of this
ordinance is for any reason held by a court of ~ompetent juris-
diction to be invalid, such decision shall not"affect the validity
of the remaining portions of this ordinance. TheCit~ Council
of the City of Saratoga hereby declares that it ~ould have passed
this ordinance and each section, subsection, sentence, clause, and
phrase thereof, lrrespectiv~ of ~h& fact that a~y one or more
sections, subsections, sentences, clauses or phrases be held
invalid or unconstitutional.
Section 5: This ordinance shall take effect and be fn full force and effect
thirty days after the date of its passage and adoption.
The above and foregoing ordinance was regularly introduced, and after the
waiting time required by law, was thereafter passed'and adopted this 19th da~
of December , 1973, by the following vote:
