AN ORDINANCE A~NDING ORDINANCE NS~5 OF THE CITY OF
SARATOGA, THE SUBDIVISION ORDINkNCE
The City Council of the City of Saratoga does hereb~ ordain as follOwS:
Section 1: There is hereby substituted for Subparagraph (1) ~f Section
2,3-2 of Part 2 of Ordinance NS-5, the followinq Sub~ar~-
graph (I}:
(1) Location of all natural creeks, streams, and other water
courses delineated on said mapJ showing top of existing banks
and creek depth, with separate sheet Showing cross-section of
'all Such creeks, streams and water courses.
Section 2: The term"curb base" set forth inSection 4,11 of Part
Ordinance NS-5, is hereby amended to read "curb face",

Section 3: The first clause of Section 8,2 of Pa~t 2 of Ordinance
NS.5 is hereby amended to read as follows:
"Section 8,2: Filing of final map with Cit~ Engineer. !~ithin
.... ' 6n6 ~ a~e~ ap~rdval of the.tentative map of a
subdivision, or within such additional.extension of time ~s
be granted pursuant to SectiOn 11554 of the Map Act, ~, ....
Section 4: All reference to a scale of 40 feet to the inch hori-
zontal and 4 feet to the inch vertical in Subparagraph
(B) of Section 8~2 of Part 2 of Ordinance NS-5 is hereby changed to
a scale of 40 or 50 feet to the inch horizontally and 4 or 5 feet
to the inch vertically, respectively.
Section S: Subparagraph (E) of Section 8,2 of Part 2 of Ordinance

NS-5 is hereby amended to read as follows:
(E) Two (2) copies of all proposed deed restrictions, or a
statement in writing si~ned by the subdivider that no deed
restrictions will be established,
Section 6: If any'section, subsection, sentence, clause or phrase of
this ordinance is for any reason held by a court of compe-
tent jurisdiction to be invalid, such decision shall not affect the
validity of the remaining portions of this ordinance, The City Council
of the City of Saratoga hereby declares that it would have passed tBis
ordinance and each section, subsection, sentence, clause and phrase
thereof, irrespective of the fact that any one or more sections, sub-
sections~ sentences, clauses or phrases be held invalid or unconsti-
tutional,
The foregoing ordinance was re.~ularly introduced an the ':3rd day
of October , 1962, and after the waitin~ time required 'by

Ordinance 'Amendments, 0rdin~nce No. NS-S~3 and Ordinance
No. NS-S.4, were filed in the office of'the Clerk of the
City of Saratoga for at least 1S days preceeding the dates
of t~ei;~!~doption:~at regular meetings of the City Council -'; ....... -:~
of the City of Saratoga held on the 17th day of October,
1962 for the adoption of Ordinance No. NS-S.5, and the
2nd day of January, 1963, for the adoption of Ordinance
No. NS-5.4.
