AN ORDINANCE AMENDING ORDINANCE
NS-5, THE SUBDIVISION ORDINANCE~
BY ADD'ING PROVISIONS RELATING TO
'HILLSIDE LOTS AND SUBDIVISIONS.
WHEREAS, the City of Saratoga deems it essential that
subdivisions in the hill areas be well planned and engineered
in order to preserve the natural environment, to provide ade-
quate building sites for low density residential use, and to
maintain safe and non-hazardous diving areas in the interest
of the general welfare'of the City, and hill and mountainous
areas have peculiar and additional problems not found in the
subdivision and development of relatively level land, and -
additional regulations being deemed necessary therefore.
NOW THEREFORE the City Council of the City of Saratoga
does hereby ordain-as follows:
SECTION I~ There is hereby added to PART TWO
Ordinance NS-5 of the City of Saratoga,
'the following Section lOm
SECTION. iO: HILLSIDE SUBDIVISIONS
SECTION 10.1: S~te~development plan required.
Where the average grade of anysingle lot~
site or parcel, or of any one or more lots
of a subdivision, exceeds ten per cent as determined by the
Director of Public Works, the applicant shall cause a site
development plan of the ~ot,.site~ parcel or subdivision in
question to be prepared and filed-at the time'of filing of
the tentative map. In addition, where because of the
peculiarity of the terrain or of one or more changes of grade
of the terrain, in the opi-nion pf the Director of Public Works
site development should be'plan~ed in'advance, a site develop-.
ment planfmay be ~equired al~houghlthe average grade is less than
ten pe~ cent. The requirements o~ these provisions of this
Section '10 shall be applicable to PART THREE of this Ordinance
as well as to this PART TWO.
SECTION 10.2: Data on site development plan.
Each site development plan shall have
delineated thereon, or be accompanied
by, each of the following items' of information:
(a) Grading Plan showing existing and
proposed topograph~ and grades of
Icut and fill slopes. '
(~) B~lding ~ocation.
(c) Septic tank and drainfield.
(d)f Provision for dra.inage.
(e) Vehicular a'cc'ess to building location.
(f) Retaining walls w~thstructural section~
(g) Soil stabilization p~anting.
(h) ~xisting n~tural vegetation.
(i) Off street parking.
SECTION 10.3: Standards of Hillside site development.
Each site development plan shall be in
accord'with such development standards
as are from time to time established by resolution of the
IPlanning Commission of the City of Saratoga or by amendment
to this ordinance.
SECTION 1~.~:~ Approval of Site development plan.
Where a site development plan is required
to be filed in accord.with this section,
no tentative site approval nor tentative subdivision approval
shall be granted by the Planning Commission until approval
thereby of the site developmen~ plan. Each such tentative
· approval shall contain as a condition thereof that if a final
map thereof is thereafter submitted and approved in accord
with said tentative map, and if said land is thereafter
developed, then said land shall only be developed in
accord with said approved site development plan.
SECTION 10.~: Site development plan as part of
improvements.
Where a site development plan has been
approved in accord with this section,
it shall automatically become a part of the improvement
plans for the lot, site, pardel or subdivision in question,
· and shall be subject to the provisions of. Section 7.1, 7.2,
and 7.3 of PART TWO of this ordinance in relation to
improvement agreements and bonds, save and except that
there shall be no requirement that the site or sites in
' - question be developed within.one year from date of final
map approval, or within any specified period of time, nor
shall there be any requirement of maintenance, as otherwise
required by Section 7..1 of PART TWO of this ordinance..
SECTION 10.6: Polidy on lot sizes.
ApproVal of a site development plan may'
require lots to be of a greater size
than the minimums as set forth in the zoniDg district in
which said lots ~r·~ located whether due to features of grade,
topography, the probability of subjection to slides,
inundation, or other hazards.
SECTIONII: Subsection (t) of Section 2.3-2 of
.! PART TWO of Ordinance NS-5, which
section is presently reserved, is hereby designated
to read as follows:
SEC. 2.3-2(t): Site development plan in accord
with Section 10 hereof, where
required.
SECTION III: If any section, subsection, sentence,
clause or phrase of this ordinance is
for any reason held by a court of competent jurisdiction
to be invalid, such decision shall not affect the validity
of the remaining portions of this ordinance. This City
Council of the City of Saratoga hereby declares that
it would have passed this ordinance and each section,.
subsection, sentence clause and phrase of this ordinance,
irrespective of the fact that any on~ or more sections,
subsections, sentences', clauses or phrases be held
invalid or unconsititutional.
The above and foregoing ordinance was regularly
introduced and after the ~aiting time required by lawlwas
thereafter passed and adopted ~ a regular meeting of the
City Council of the City of Saratoga'held on the lY~h
d~y of Juue , 1964.
