AN ORDINANCE AMENDING ORDINANCE NS-60, THE
SUBDIVISION ORDINANCE OF THE CITy OF SARATOGA,
BY ADDING SECTION 27 TO ARTICLE THREE RELATING
TO AN ALTERNATE PROCEDURE FOR SINGLE SITE
APPROVAL NOT INVOLVING LAND DIVISION, AND
AMENDING SECTION 21 TO CONFORM THERETO.
The City Council of the City of Saratoga does hereby
ordain as follows:
Section 1: Section 21 of Ordinance NS-60 is hereby
amended by adding Subparagraph (e) thereto, to read as
follows:
(e) Where site approval for a single site
Or parcel, not involving any land division,
is obtained in accord with Section27 of
this Article.
Section 2: Section 27 is hereby added to Article
Three of Ordinance NS-60 to read as follows:
Section 27: Alternate Procedure - Sinqle Lots.
Anything to the contrary hereinabove set forth
in this Article Three notwithstanding, where no
division of land is involved and site approval is
otherwise required for a single lot or single parcel,
......... the~following-alternate.procedu~e shall be applicable
at the option of the property owner:
(1) Application for site approval shall be made
to the Planning Director and shall include
a written application, tentative map and
application fee.
(2 The Planning Director shall refer the applica-
tion to the Land Development Committee (LDC)
for action at its next regular meeting wfth-
out compliance with Section 12 of Article
~o or Section 22 or 24 of this Article Three,
except as hereafter noted; and that Committee
may impose such reasonable conditions on
site approval as it deems applicable in accord
with general subdivision design requirements
and improvement requirements of Section 13
and 14 hereof, as may be necessary in each
.... particular case in o~d~r to pro~t the
\~ public health, safety or general welfare.
"Such conditions may include the preparation
.. and.recordation of a Parcel Map in the event'
~ ~'thA~ho boundary survey map exists on file
with the Santa Clara County Recorder's Office.
The City Council may from time to time, By
ordinance or resolution, establish modified
criteria in relation to conditions to be
imposed under this alternate procedure.

(3) Final site approval shall become consummated
when all conditions imposed by the Land
Development Committee have been satisfac-
torily met and such is evidenced by a
certificate of compliance issued by the
Director of Public Works. Said certificate
shall be of satisfactory form for record-
ing and, in cases where no. parcel map is
required, shall be recorded with the Santa
Clara County Recorder.
In the event the property owner is dissatisfied
with any of the requirements or conditions imposed
by the LDC, or by the decision of the Planning Director
or Public Works Director under the provisions of this
alternate procedure,' then site approval shall be
secured by application to the Advisory Agency and
full compliance with Sections 22 through 24 of this
Article Three.
Section 3: If any section, subsection, sentence, clause
or phrase of this ordinance is for any reason held by a court
of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Saratoga hereby
declares that it would have passed this ordinance and each
section, subsection, sentence, clause and phrase thereof,
irrespective of the fact that any one or more sections, subsec-
tions, sentences, clauses or phrases be held invalid or uncon-
stitutional.
Section 4: This Ordinance shall take effect and be
i~ full force and effect thirty (30) days from the date of its
passage and adoption.
This Ordinance was regularly introduced and after the
waiting time required.by law was thereafter passed and adopted
at a regular meeting of the City Council held on the 1st day
of November 1978, by the following vote:
