HomeMy WebLinkAboutCity Council Resolution 02-067RESOLUTION NO. 02-067 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA INITIATING FINAL DESIGNATION OF AUSTIN WAY A HERITAGE LANE WHEREAS, the Heritage Preservation Commission has on its own initiative considered designating Austin Way as a Heritage Lane and has held several public meetings to consider said designation and has recommended that said designation be adopted by the City Council; and WHEREAS, the Heritage Preservation Commission mailed written notice of its recommendation to each person whose name appeared on the latest available County tax roll as owning property abutting Austin Way describing the designation and advising the recipients of their right to file written objections to the proposal and written objections were received from 18 percent of the affected landowners; and WHERAS, the recommendation of the Heritage Preservation Commission was forwarded to the Planning Commission which conducted a public hearing on the proposed designation after mailing notice of the hearing to each person whose name appeared on the latest available County tax roll as owning property abutting Austin Way; and WHEREAS, following the public hearing on the proposed designation the Planning Commission recommended that the City Council approve the proposed designation by adopting the ordinance attached hereto as Attachment 2; and WHEREAS, the City Council has reviewed the recommendation of the Planning Commission, the report and recommendations of the Heritage Commission, the information and documentation pertaining thereto, and the correspondence from the public concerning the proposed designation. Written objections were received from 18 percent of the affected landowners and considered by the Heritage Preservation Commission. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Saratoga does hereby: 1. Determine that Austin Way should be considered for designation as a Heritage Lane; 2. Initiate final designation proceedings for Austin Way; 3. Direct the City Clerk to schedule a public hearing on the proposed designation at the next available City Council meeting after notice maybe given and no more than 60 days from the date of this resolution; and 4. Direct that no action be taken by the City within the next I20 days that would cover or remove the exposed brickwork on Austin Way. The foregoing resolution was adopted by the following vote on the 4th day of September 2002.
