HomeMy WebLinkAboutCity Council Resolution 02-090RESOLUTION N0.02-090 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA DECLARING HAZARDOUS VEGETATION GROWING ON CERTAIN DESCRIBED PROPERTY TO BE A PUBLIC NUISANCE AND SETTING A PUBLIC HEARING WHEREAS, hazardous vegetation is growing in the City of Sazatoga upon certain streets, sidewalks, highway, roads and private property; and WHEREAS, said vegetation attain such growth as to become a fire menace or aze otherwise noxious or dangerous; and WHEREAS, said vegetation constitute a public nuisance. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Sazatoga, as follows: 1. That hazazdous vegetation does now constitute a public nuisance; 2. That said nuisance exists upon all the streets, sidewalks, highways, roads and private property, more particulazly described by common name or by reference to the tract, block, lot, code area and parcel number on the report prepared by and on file in the office of the County Fire Mazshal; 3. That it is ordered that Wednesday, the 15th day of January 2003, at public hearing during a regular meeting which will begin at 7:30 p.m. in the Saratoga Civic Theater, 13777 Fruitvale Avenue, is hereby fixed as the time and place where objections to the proposed destruction and removal of said vegetation shall be heazd and given due consideration; 4. That the County Fire Marshal is hereby designated as the person to cause notice to be given in the manner and form provided in Article 15, Chapter 7 of the Sazatoga Municipal Code, and as the person to hereafter cause abatement of such seasonal and recurring nuisance. The above and foregoing resolution was passed and adopted by the Sazatoga City Council at a regulaz adjourned meeting held on the 4th day of December 2002, by the following vote: AYES: Councilmembers Stan Bogosian, John Mehaffey, Ann Waltonsmith, Vice Mayor Evan Baker, Mayor Nick Streit NOES: None ABSTAIN: None ABSENT: None Nick Streit, Mayor
