HEAD: SUBJECT: Status report on Saratoga Creek Settlement Agreement Activities The following briefly describes the status of each of the activities required in connection with the Saratoga Creek Litigation Settlement Agreement. The progress reported for each activity reflects what has been accomplished since the previous status report dated October 26, 1999. A. No-dumping stencils - As previously reported, these have been installed per the terms of the agreement. B. Warning signs - As previously reported, these have been installed per the terms of the agreement. Water Quality Testing - No additional water quality testing of samples taken directly from Saratoga Creek has been performed since the October 4 sampling event. The next round of sampling is scheduled to occur in mid-May, weather permitting. Prior to this time, additional video surveying of both the Fourth Street and Saratoga-Sunnyvale Road storm drain systems will be performed with the assistance of the West Valley Sanitation District in an effort to identify potential locations of groundwater/sanitary sewer infiltration that leads to high fecal coliform concentrations in the creek at both outfall locations. Friends of Santa Clara Creeks will also participate in the video surveying effort. Storm Drain Maps - City staff continues to refine the storm drain maps being produced on the City's new GIS system. Unfortunately, most of the previous work performed by the West Valley Sanitation District has proven to be unreliable so the City's engineering staff is creating the entire maps from scratch. Targeted completion is now the end of March due to the unanticipated additional work required and the time devoted to completing the maps of parcels not connected to the public sanitary sewer system for aid in implementing the Septic System Abatement Ordinance. Discharge Response Plan - Publication of the Plan in the Saratoga News was put on hold pending resolution of issues in connection with recent SFD response to a reported discharge incident. City remains concerned about SFD's willingness to handle responses as previously agreed to. Assuming concerns can be addressed, Plan will be published in March. If concerns cannot be satisfactorily addressed, Plan will need to be modified before it is published. Additional publication of the Plan in the second and future editions of the City's newsletter is also anticipated. Storm Drain Sag Repair - Both sags were cleaned in May and August. Fourth Street sag will be cleaned prior to video survey of the storm drain system. Future repair of sags to occur when SFD Fire Station is rebuilt, and when Fourth Street Bridge is replaced. Non-storm water effluent from the outfall at Saratoga-Sunnyvale Road - City continues to work closely with Friends of Santa Clara Creeks to pinpoint sources of high fecal effluent from the outfall (see discussion of video surveying in C above) documented in previous water sampling events. Recently completed profile mapping of the sanitary and storm sewers have identified one suspect location where the sanitary sewer crosses above the storm drain by only several inches. This will be further investigated as a possible sewage infiltration point. Septic System Phase-Out - Complete maps of all properties identified by West Valley and Cupertino Sanitary Districts have been prepared by the City's engineering staff on the new GIS system. A Microsoft Access database has also been created by a West Valley College volunteer to track compliance status of all parcels subject to the new Ordinance. The City's Notice to Abate and cover letter have been finalized and reviewed by the Sanitation Districts and are scheduled to be mailed to property owners by the end of this week. I. Attorney's fees and costs - Second installment payment to Plaintiff's attorneys made on July 1. Third and final installment to be paid on July 1, 2000.
