HEAD: ~--~~--~---~- SUBJECT: Appointment and Confirmation of Department Heads RECOMMENDED ACTION(S): Adopt resolutions confirming Appointment of Department Heads. 'BACKGROUND: While reviewing the draft of the CAFR recently I happened upon a phrase that caused me to research the Municipal Code concerning appointment of department heads. Upon further investigation I determined that code section 2-20.050(d) requires City Council confirmation of City Manager appointments of department head level positions. Ordinance 15-M in 1972 established the position of City Manager from the prior position of City Administrator. The language under discussion was adopted at that time and was a remnant of the prior practice of Council appointments. The City Clerk has researched the past practice of' the City and only two instances of confirmation can be found to date. One is for the appointment of Paul Curtis as Planning Director in 1992 and a staff report recognizing John Cherbone as Public Works Director on his appointment to that position in June of 2000. A comprehensive search of the Council minutes and Council Resolutions reveals no other Council confirmation of an appointment of a department head by a City Manager. DISCUSSION: The current City Manager has appointed three department heads since his tenure began in August of 1990. Tom Sullivan, Director of'Community Development - May 14, 2001, Lorie Tinfow, Assistant City Manager - June 25, 2001, and Jesse Baloca, Administrative Services Director - October 22, 2001. Joan Pisani, Director of Recreation Department was appointed July 1,1987, and John Cherbone, Director of Public Works was appointed June 7, 2000. A resolution is attached stating the appointment date of each individual by the City Manager and the confirmation date in the form of a resolution of the City Council. Given the language in the code the City Attomey and I have concluded that the Council needs to take a formal action on the confirmation of each department head upon appointment by the City Manager. The recommended form of-this confirmation is a resolution stating the date of each appointment and confirmation so it can be inserted in the department head's personnel file. I have also included Resolutions of Confirmation for the Director of Public Works, John Cherbone and the Director of Recreation, Joan Pisani so that it can be placed in their personnel file to show conformance to the code. FISCAL IMPACTS: N/A CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S): Department Directors would remain unconfirmed by the City Council. ALTERNATIVE ACTION(S): Provide direction on alternative approaches to confirmation of department head appointment by any method other than Council Resolutions. FOLLOW UP ACTION(S): City Clerk provides certified copies of confirmation Resolutions to Department Directors for placement in personnel file. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Saratoga does hereby proclaim that it is the appropriate time to bring forward the following director: Tom Sullivan, Community Development Director who was appointed on May 14, 2001and confirmed by the City Council on November 7, 2001. 'NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Saratoga does hereby proclaim that it is the appropriate time to bring forward the following director: Lorie Tinfow, Assistant City Manager who was appointed on June 25, 2001and confirmed by the City Council on November 7, 2001. NOW, THEREFORE, BE IT RESOLVED, by the City Council 'of the City of Saratoga does hereby proclaim that it is the appropriate time to bring forward the following director: Jesse Baloca, Administrative Services Director who was appointed on October 22, 2001and confirmed by the City Council on November 7, 2001.
