Owner's Statement
We hereby state that we are the owners of or have some rigght title or
interest in and to the real property included within the subdivision shown
on the map; that we are the only persons whose consent is necessary to pass
a clear title to said real property, that we hereby consent to the making
of said map and subdivision as shown within the distinctive symbol border
line• and that we hereby offer for dedication to public use all streets
and portions of streets not previously existing as shown on the map within
said subdivision and also dedicate to public use easements for any and all
public uses under, upon and over said streets and said portions thereof.
We also hereby dedicate to public use easements for any and all utility
facilities including polczi, wires, conduit, gas, water, sewer mains an all
appurtenances to ,the above, under upon or over those strips of land
designated P.U.E. (Public Utility Vasement). The above mentioned Public
Utility Easements to be kept open and free from buildings and structures of
any kind except public utility facilities, private storm drains, private .
sanitary sewers, water services, irrigation systems and appurtenances thereto,
lawful fences, surface pavement and all lawful unsupported roof overhangs.
We also hereby dedicate to the public no ;build easements over portions of
Lots 1,2,3,4 designated hereon as No —Build Easement . The above No —Build
easements to be kept, free from buildings and structures of any kind except
Irrigation systems and appurtenances thereto, lawful fences, surface pavement,
private storm drains, private sanitary sewer, wa'ter services, private conduits,
and all lawful unsupported roof overhangs. The areas within ' the banks of any
natural drainage course located within a No- -Build easement shall be left in a
natural state, any vegitation removed from within the banks of a natural
drainage course shall be replaced with native .vegitation.
We also hereby dedicate to public use easements for water line purposes under,
n, or over those certain strips of land designated and delineated as WLE
Water Line Easement). Said easements to be kept open and free from all buildings
and structures of any kind except irrigation systems and appurtenances thereto,
lawful, fences, private storm drains, private sanitary sewers, water services,
surface pavement, private conduits and all lawful unsupported roof overhangs.
We also hereby reserve for the Owners of Lots 1 through 10 easements for Storm
Drainage Purposes and Sanitary Sewer Purposes under, on or over those certain
,, land designated and d lineated as "SDEk" Storm Drainage Easement) and
SE Sanitary Sewer Easement , Sold easements io be kept open and free ?rom all
buildings and-structures of any ind except irrigation systems and appurtenances
thereto, water services, lawful fences and all lawful unsupported roof overhangs.
Said easements are not offered for use to the ,general ppublic but are intended
fer the exclusive use of owners of Lots 1 through 10, tF�eir successors and assigns.
We also hereby, reserve for the use of the owners of Lot 1 and Lots 3 through 10
,Vasemgn s for sidewalks, slopes and aintenance over those-strips of land designated
S.M.E. Street Maintenance Easement. The above mentioned Street Maintenace Easements
to be kept open and free from buildings and structures of any kind except public
utility structures, private storm drains, private sanitary sewers, water services,
irrigation systems and : appurtenances thereto, surface pavement lawful fences and all
lawful unsupported roof overhangs. Said easements, are not offered. for use to the
general public 7 but are intended for the exclusive use of the owners of Lot 1 and
Lots 3 through 10, their _successors and assigns.
We also hereby reserve for the use of the Owners of Lots 1 through 11 easements for
landscaping of alai tenance over, those strips of land lying along Bohlman Road
designated L.M.E. Landscape Maintenance Easement). The above mentioned Landscape
Maintenace Easemen s to be kept open and free - from buildings and structures of an p
kind except irrigation systems and appurtenances thereto, lawful fences, and surface y
pavement. Said easement is not offered for use to the general public but is intended
for the exclusive use of the owners of Lots 1 through 1T, their successors and assigns.
We also hereby reserve for the use of the Owners of Lot 1 rights of vehicular and
pedestrian In ess and Egress upon and over that certain strip of land designated
as Driveway Tasement" as shown hereon over Lot 4 for the benefit of Lot 1. Said
easement is not offered for use of the general public but is intended for the use
of the owners of Lot 1, their 'icensees, visitors, and tenants.
We also hereby reserve for the Owners of Lot 1 and Lots 3 through 10 Reciprocal
Easements for the private street contained within this Tract delineated as
' Private Street Easement— Cuvilly Way". Said private street fs not offered for
use to the general public but Is Intended for the exclusive use of the owners of
Lot 1 and Lots 3 through 10 their successors and assigns for Public Utilities,
Private Utilities, Drainage, Reciprocal rights of vehicular and pedestrian ingress
and Egress and Emergency Access purposes. Said private street is to be kept open
and free of buildings and structures of any kind except public utility service
structures, private storm drains, private sanitary sewers, ,water services, irrigation
systems and appurtenances thereto, lawful fences, and surface pavement.
We also hereby reserve a easement for a pathway over Lot 4 for the benefit of Lot 1.
Said easemenf designated as Pathway Easement is not offered for use of the general
public but Is Jntended for the use of the owner of Lot 1, there licensees, visitors,
and tenants.
We also hereby join with the City and agree that any further subdivision of this Tract
No. 9330 or any Lot thereof shall be expressly prohibited without approval, from the City
of Saratoga.
