REPORT OF POSTING AGENDA
Director Walgren announced that pursuant to Government Code 54954.2, the agenda for this meeting was
properly posted on May 5, 2000.
TECHNICAL CORRECTIONS TO PACKET
Director Walgren reported that a correction needed to be made on Agenda Item 2. The detached structure
should be referred to as “cottage” rather than “garage.”
CONSENT CALENDAR
PUBLIC HEARINGS
1. DR-99-010 & V-99-005 (517-14-078) – TAORMINA, 15500 Quickert Road; Request for Design
Review and Variance approval to construct a new 6,268 square foot two-story residence. Variance
approval is required to allow a retaining wall to exceed five feet in height. The property is 3.1 acres
(net) and is located within a Hillside Residential zoning district. (CONTINUED FROM 4/12/00)
Director Walgren presented the staff report, noting that applicants are requesting Design Review
approval to construct a new 6,268 square foot two-story residence. The Planning Commission originally
reviewed the application at the April 12, 2000, Commission hearing and felt the design was not sensitive
to the natural environment and expressed a desire that the design, colors, and materials used should
reflect a more rural style. The applicant made architectural changes to the plans including elevation and
material. Staff found that the applicant complied with the directions from the April Commission meeting
and recommends approval.
Commissioner Kurasch asked about changes in the basement.
Director Walgren said the change recommended by staff was that the basement be pulled back, away
from the edge of the pad. The recommendation is to reduce the area of the basement by eliminating the
portion projecting towards the face of the slope..
Commissioner Barry said a comment was made in the minutes was not dealt with, specifically about the
structure being too bulky for the hillside. She asked if staff had any discussion with the applicant about
reducing the bulk.
Director Walgren recalled that the majority of the motion was to address the architectural changes and
there was no discussion by staff about bulk.

Commissioner Bernald thought the design should be integrated into the hillside.
Chairman Page opened the public hearing at 7:58 p.m.
Maurice Camargo, 3953 Yolo Drive, San Jose, said they proposed to eliminate the light well exit on the
side of the building. The original design stepped the residence down the hill, but when he recognized
that building on a 40% slope would require a variance, the house was moved on the existing pad. He
provided a detailed rendering that showed how the house sits on the hill. The lower side of the hill has
an open area below the house., and the down hill side of the house was heavily wooded.
Commissioner Bernald noticed the “billboard” design on the entry way.
Mr. Camargo said the arched opening was maintained with a lattice treatment over the entry. He looked
at options including square type columns.
Director Walgren said the house was relatively large on a narrow pad. The issues of mass and bulk were
integrated into the site. Regarding the entryway, he suggested adding a condition of approval that some
elements from the original design be further modified.
Commissioner Kurasch expressed concern about the size of the structure, the unstable soils, and
drainage. She asked how the applicant can guarantee to the residents that the problems would not recur.
David Pitzen, 6524 Creekbank Court, San Jose, explained how extensive soil work was done prior to
purchasing and designing the house. Concerns that people had with slides on the property was due to
the fact that the property was not maintained properly. Slide problems have been mitigated.
Improvements on the property will benefit the site. Decisions were made based on rules provided by the
City and a house integrated into the slope was best for the property. He put his company on the line and
hired engineers and geologists who staked their careers and reputations on their work.
Director Walgren said the application was first submitted in early 1999, and it took quite awhile for City
geologic clearance. Staff required an engineered drainage plan be designed.
Commissioner Roupe preferred the treatments of the sketch presented with this evening’s proposal. He
suggested a condition be added that the subsequent final plan of the front elevation will be subject to
staff approval.
Director Walgren said the staff recommendation was for the front entryway.
Mr. Pitzen said he was open to the Planning Commission’s feedback. If the massing was the question, he
would look at what could be done to satisfy the Commission’s concerns. As a builder, he looked for a
means in which to work towards a solution, but found it difficult to integrate everyone’s ideas into a
home that could be built.
COMMISSIONERS PATRICK/ROUPE MOVED TO CLOSE THE PUBLIC HEARING (AT 8:20 P.M.).
PASSED 7-0.
Commissioner Barry recognized the work the applicants did regarding the road, retaining wall, and
drainage. She commended the architect for the change in the material from stucco to wood. She
expressed concern about the bulk and said an 8,532 square foot house is an excessive amount of building

for the hillside. She would like to see the house redesigned so it was not as massive.
Commissioner Patrick liked the design, but was not comfortable with the fact that she did not know
what the design actually is. The entryway issue should be handled by staff. She concurred the house is
too big and could not approve the house on this lot. She was also concerned about the 20’ retaining
walls.
Director Walgren said the highest part of the retaining wall is 12 feet.
Commissioner Jackman agreed the house is too big for the site.
Commissioner Bernald said the design should step down the slope and be a less obtrusive building.
Commissioner Kurasch said the lack of story poles meant that questions from neighbors regarding views
could not be answered. She was concerned about the size and bulk of the house and recalled comments
from neighbors that the house doubled and tripled other houses in the area.
Commissioner Roupe commended the applicant for responding to comments raised by staff. He thought
the house would look better integrated into the slope and the applicant might want to consider getting a
variance to do that to reduce the overall appearance of massive bulk. He was willing to consider the
variance more than approving the structure on the existing pad. He urged continuance of the item due to
the confusion about the design that was being approved.
Director Walgren said the applicants originally proposed the building to be pushed down slope away
from the pad. The amendments discussed at the meeting were detail items that could be handled simply.
He understood the Commission wanted the applicant to significantly reduce the square footage of the
home to reduce the building’s mass to better integrate it into the site.
Commissioner Kurasch wanted to see the house stepped up the slope and the front of the house would be
moved back.
Commissioner Barry was willing to leave open to the discretion of the geologist, civil engineers,
architects and builders any design that reduced bulk.
Chairman Page was unsure that moving the house up the hill was the best way to go. He felt the
consensus of the Commission was that they did not feel comfortable with the application and would like
to see it again. He suggested a study session might be appropriate.
Director Walgren thought a study session was a good idea. He understood the Commission wanted the
applicant to significantly reduce the size of the building to reduce the mass and bulk.
Chairman Page said the direction to the applicant included decreasing the size of the house.
COMMISSIONERS ROUPE/KURASCH MOVED TO REOPEN THE PUBLIC HEARING AT 8:44 P.M.
(PASSED 7-0).
Mr. Pitzen said the guidelines for building a house given by the city were reviewed. He knew what size
house was allowed, and the decision to purchase the land is based on information from the City. He
added that a topography study was done and the house was based on a mathematical equation. He said

he would be willing to continue to make the majority of the Commission satisfied with the design.
Commissioner Barry said the Commission needed to make clear what the formula for square footage is
about. Under the Design Review Handbook, subsection “Maximum Standards” says “the standards set
forth in this section are intended to be maximum figures and the Planning Commission may, in any case,
require that the floor area be reduced below the applicable standard if such reduction is necessary in
order to make findings prescribed.” The Commission’s job, mandated by law, is to apply the design
review standards. The maximum allowable is not an entitlement but at the discretion of the Planning
Commission in implementing the design review standards.

COMMISSIONERS BARRY/JACKMAN MOVED TO SET A STUDY SESSION WITH THE
APPLICANT ON JUNE 14, 2000. PASSED 7-0.
2. UP-00-002 (397-18-038) – SCUDELLARI, 14855 Baranga Lane; Request for Use Permit approval
for the construction of a 306 square foot cabana within the rear yard setback area. The height of
the cabana will be 13 feet, 10 inches. The 1.6-acre site is developed with a single family residence
and is located within an R-1-40, 000-zoning district.
Director Walgren presented the staff report, noting that the applicant requested Use Permit approval for
the construction of a 306 square foot cabana within the rear yard setback area. The request also includes
Planning Commission approval to grant an exception to allow the garage to be 13 feet, 10 inches tall,
where 12 feet is the maximum height allowed for an accessory building. Staff found the application to be
appropriate and recommends approval of the conditional use permit.
Chairman Page opened the public hearing at 8:54 p.m.
Rick Scudellari, 14855 Baranga Lane, said the cabana would be used in connection with the pool, and the
variance is to make the roof compatible with the house. He received no comments from the neighbors to
the rear of his property.
Wen-Li Lin, 14788 Live Oak Lane, wanted the applicant to plant tall trees around the side fence for
privacy.
Mr. Scudellari said Ms. Lin’s request was unrelated to the application, but he did plan to add more trees.
Commissioner Kurasch asked if Mr. Scudellari would be opposed to screening directly behind the
cabana.
Mr. Scudellari said he will screen the entire back yard, specifically around the pool area.
COMMISSIONERS PATRICK/KURASCH MOVED TO CLOSE THE PUBLIC HEARING (AT 9:00
P.M.). PASSED 7-0.
Commissioner Bernald supported the height of the cabana to match the roof of the house.
COMMISSIONERS BERNALD/PATRICK MOVED TO APPROVE UP-00-002. PASSED 7-0.

3. DR-00-008 (397-35-015) – SINGH, 19306 Pinnacle Court; Request for Design Review approval
for the demolition of the existing 4,660 square foot, two-story residence and the construction of a
new 5,438 square foot, two-story residence. The site is 40,009 square feet and is located within an
R-1-40, 000-zoning district.
Director Walgren presented the staff report, noting that the application was for Design Review approval
for the demolition of the existing 4,660 square foot, two-story residence and the construction of a new
5,438 square foot, two-story residence. Staff agreed that the home was smaller than the original house but
too ornate. The applicants revised the plan to reduce the visual elements. Staff recommends approval
with conditions in the resolution.
Chairman Page opened the public hearing at 9:13 p.m.
Louis Leu, architect, said he did not want to deviate too much from the original design. He found it more
practical to build a new house. The style, character and massing will be similar to the original house.
The landscaping will be improved to provide additional screening and privacy. The property owner, Mr.
Singh, talked to the neighbors and they supported the project.
Ralph Borelli, 19301 Pinnacle Court, supported the plan and said it was an improvement to the
neighborhood.
Commissioner Kurasch asked about permeability of the paving stone for the drive area.
Tim Hogueland, landscape architect, said the product is new to the United States, and he has had
experience working with the stone. The stones interlock.
COMMISSIONERS PATRICK/JACKMAN MOVED TO CLOSE THE PUBLIC HEARING (AT 9:20
P.M.) PASSED 7-0.
Commissioner Patrick said the project was well designed and well thought out.
Commissioner Jackman concurred and said it was an improvement over the old house.
Commissioner Bernald appreciated the changes recommended by staff and felt the project was
compatible with the neighborhood. She was pleased that the applicant worked with the neighbors and
received their approval.
Commissioners Kurasch, Roupe, and Barry concurred with the comments of the other Commissioners.
COMMISSIONERS KURASCH/ROUPE MOVED TO APPROVE DR-00-008. PASSED 7-0.
4. SD-99-004 & V-99-008 (397-04-060) – JEAN, 14906 Sobey Road; Application for Subdivision
approval to split an existing 2.3-acre parcel into two parcels. An application for Variance approval
is also requested to allow the existing residence to maintain an existing non-conforming setback

and to allow the existing second unit to maintain its current location, which intrudes into the
newly-created front yard setback. Adoption of an Environmental Negative Declaration is also
requested, pursuant to the requirements of the California Environmental Quality Act. The parcel is
located within an R-1-40, 000-zoning district.
Director Walgren presented the staff report, noting that the request was for Tentative Parcel Map
approval to subdivide into two parcels an existing 2.3 acre parcel containing one existing residence and a
cottage. A variance is also requested to allow the existing residence to remain with non-conforming
setbacks as a result of the subdivision. Staff feels the variance findings can be made, noting the house is
already located on the property. The detached cottage would be within the required front yard setback.
Staff recommends approval because the existing structure is in good condition.
Commissioner Jackman asked if the cottage is currently a second living unit with a kitchen.
Director Walgren said the cottage qualified as a second living unit. If the property owners choose to
legalize the cottage as a second living unit, that could be accomplished with an administrative second
unit permit.
Director Walgren reviewed the findings for variances.

Robert McBain, 1952 Camden Avenue, Suite 102, San Jose, said the project will help the neighborhood
take care of drainage problems. The property owners met with the neighbors who supported the project.
The property owners will live on one lot but have not fully planned what to do with the secondary unit.
COMMISSIONERS PATRICK/BERNALD MOVED TO CLOSE THE PUBLIC HEARING (AT 9:40 P.M.)
PASSED 7-0.
Commissioner Kurasch had no problem with the variance for the existing home. The impervious coverage
would have an impact on future development of the property.
COMMISSIONERS JACKMAN/PATRICK MOVED TO ADOPT THE NEGATIVE DECLARATION.
PASSED 7-0.
COMMISSIONERS ROUPE/BERNALD MOVED TO APPROVE SD-99-004.
Commissioner Kurasch suggested adding a condition to retain the cottage as a second dwelling unit.
Commissioner Roupe asked if there is a time limit when the applicant has to elect to retain the kitchen.
Director Walgren recommended this be resolved prior to recording the final map. The kitchen would be
removed or a permit would be applied for to legalize the structure to be retained as a second dwelling
unit.
Commissioner Barry asked if imposing a condition on a lot split was appropriate and thought that there
was a condition requiring that the second lot be a one-story house because of the views and maintenance
of the neighborhood character. He thought this would be worth discussing.
Commissioner Jackman said it was not appropriate to add restrictions for one story.

Commissioner Kurasch asked if a unit is legalized as a second dwelling unit, does that obligate or require
the homeowners to use the property in that way.
Director Walgren said that would not obligate the homeowners.
Commissioner Roupe said the applicant would have to go through the regular process to legalize the
unit.
MOTION TO APPROVE SD-99-004 PASSED 7-0.
COMMISSIONERS ROUPE/BERNALD MOVED TO APPROVE V-99-008. PASSED 7-0.
5. SD-99-006 (389-06-002) – STURLA, Saratoga Creek Drive; Application for Subdivision
approval to split an existing 1.3-acre parcel into two parcels. The parcel is located within a
Professional-Administrative Offices zoning district.
Director Walgren presented the staff report, noting that the application was a request for Tentative
Parcel Map approval to subdivide into two parcels an existing 1.3 acre vacant parcel. The property is
located in a Professional-Administrative Office zoning district. A riparian habitat was required to be
prepared to identify any endangered or special species of plants or animals and to identify a riparian
easement that would be recorded as part of the Tentative Map. Staff recommends approval of the
subdivision application.

Warren Sturla, 211 B Shelley Avenue, Campbell, was present to answer any questions.
COMMISSIONERS BERNALD/ROUPE MOVED TO CLOSE THE PUBLIC HEARING AT 10:02 P.M.
PASSED 7-0.
Commissioner Jackman favored approving the application as presented.
Commissioner Kurasch was not comfortable with the riparian easement dedication and would like a
stated minimum with the biotic requirement.
Director Walgren suggested requiring the Tentative Map come back to the Planning Commission once
the riparian easement was identified and prior to recording of the Map.
Commissioner Barry said she would approve the application knowing the final map with riparian
easement described would come back to the Planning Commission.
Commissioner Patrick did not believe the Planning Commission had the ability to change the riparian
easement. She would not require a review of the map to look at the riparian easement.
Commissioner Kurasch said having more information in an area that has been described as having some
species of concern was consistent with City policy to describe it further. She was concerned about not

having a minimum in the policy.
Director Walgren said he would bring it back before the map is finaled.
Commissioner Roupe was hesitant to overlay general guidelines that might be precedent setting.
Director Walgren recommended taking the wildlife biologist’s recommendation as to where the
easement should go.
COMMISSIONERS PATRICK/BERNALD MOVED TO APPROVE SD-99-006. PASSED 7-0.
6. DR-98-044 (503-13-021) – CHIU, 21777 Mt. Eden Road; Request for Design Review approval to
demolish an existing 2,488 square foot, single story residence, and construct a 6,720 square foot,
single story residence with a maximum height of 23 feet. The project was originally heard at the
November 10, 1999 Planning Commission hearing and continued to a date uncertain for design
revisions. The site is located on a 2.7 (net) acre parcel within a Hillside Residential zoning district.
Director Walgren presented the staff report, noting that the applicants are requesting Design Review
approval to demolish an existing 2,488 square foot single-story residence and construct a new 6,720 square
foot single-story residence with a maximum building height of 23 feet. The building was reduced by 600
square feet, the height was reduced from 26 feet to 23 feet, terraces were removed, stone added, and the
color was changed to integrate the house into the surrounding natural environment. Two trees that were
previously proposed to be removed will be retained, and the impervious coverage was reduced. Staff
recommends approval of the application.
Chairman Page opened the public hearing at 10:15 p.m.
Scott Stotler, 275 Tennent Avenue, #100, Morgan Hill, provided a rendering showing the relationship of the
width of the house to the size of the lot. He noted that there was more stone and the colors were earth tone.
The lot coverage was reduced and setbacks increased.
Commissioner Barry liked the stone and the change in colors. She questioned whether the columns were
helpful to the design.
Mr. Stotler said the columns were a cut stone look. The owner chose to construct a single-story house
which he felt blended better with the area. The pad is 10 feet below the street, and there would be a large
front setback.
Commissioner Patrick asked if the applicant was opposed to removing the columns and replacing them
with square or rectangular boxed stone worked columns.
Mr. Stotler said it was the owner’s desire to keep the columns.
Commissioner Kurasch noted the Calabasas Creek ran through the back of the property and asked if the
applicant had any objection to including plants native to the area.
Director Walgren said in addition to the Water District regulations, the riparian protection ordinance
required that setbacks for structures near creeks had to be measured from the top of the creekbank.

Commissioner Bernald did not see the home as compatible with the existing neighborhood.
Commissioner Roupe was concerned about the visual impact.
Commissioner Kurasch was unable to say whether it is compatible.
Commissioner Barry said the requirement that rural character be maintained did not appear. She would like
to see the house be different to comply with the rural character. She would like to see the columns changed
and hoped the landscape plan would not have the formal entry depicted on the schematic.
Director Walgren said the landscape plan could be returned to have more natural looking landscaping.
Commissioner Patrick said the flat, exposed property caused the house to be more visible. She was
concerned about the landscaping and ranch style mansion. She suggested more natural landscaping, more
trees, less formal, no columns, and no cypress trees.
Commissioner Jackman approved the new color board. She wants to see a different landscape plan that
would hide the house.
Chairman Page said the property was flat and very visible, but the stone veneer helps blend it in. He was
not comfortable with the appearance of the house.
Commissioner Kurasch said placing the house closer to the street might make it more compatible with the
hillside goals. She would like to see less driveway.
Commissioner Bernald did not think the design was compatible with the neighborhood.
Director Walgren said the fact the house is so far from the front property lien, an asymmetrical landscape
plan and the box columns might help the house fit on the site.
Commissioner Roupe suggested continuance of the item for a landscape plan to be brought back to the
Commission.
Director Walgren recommended approval subject to final approval of the detail item.

Commissioner Patrick did not want the item continued. Chairman Page agreed.
Mr. Stotler said there would be no cypress trees on the property. The rendering did not reflect the actual
landscaping. He met with staff to address concerns raised in November. The garage on the right side of the
house was eliminated, square footage was cut back, and more natural elements were included. The Chius
will landscape according to staff’s direction.

DIRECTOR ITEMS
– Summary materials from Planning Commission’s March 10, 2000 retreat
– Request for a May 24, 2000 study meeting
Director Walgren summarized the materials in the packet from the retreat which were presented for the
Commission’s information.
Commissioner Jackman said she would like to discuss the items at a later point.
Director Walgren said a request was received from Stan Gamble who submitted a mixed use
development on Big Basin Way. Mr. Gamble developed a plan that included a retail component in the
front and residences in the back and wanted to come before the Planning Commission at a study session
on May 24. The Planning Commission needs to weigh if a study session would benefit Mr. Gamble prior
to the item being heard at a hearing. Staff told Mr. Gamble that he needs to work on increasing the
commercial component and reduce the residential component. The Commission concurred that a study
session was not necessary.

Director Walgren reported that the application was submitted just before the event began. Staff issued
an administrative permit to allow the event to start with the understanding the permit would be subject
to the discretionary permit hearing. Staff received no complaints and did not anticipate any parking
problems.
Staff recommended the permit be approved.
Commissioner Patrick asked if the late application caused the City extra cost.
Director Walgren said it did not add an increase in staff time.
Commissioner Patrick recalled the same thing happened two years ago which required more staff time.

Commissioner Kurasch suggested the applicant be notified that they would be subject to a fine if they
did not get a permit prior to the event taking place.
Commissioner Jackman did not think a fine should be imposed this year, but it should be made clear that
the application must be submitted early or there will be fines.
Commissioner Patrick recalled the applicants were told the last time that they needed to apply for a
permit, suggesting fining them $250 for signs that were put up prior to the administrative permit being
issued.
Chairman Page questioned whether a fine would make any difference.
Commissioner Barry asked if a lesser fine could be imposed and if it was possible to impose and waive a
fine.
Commissioners Barry, Patrick, Bernald and Kurasch concurred a fine of $250 should be imposed;
Commissioners Jackman and Roupe disagreed.
Chairman Page announced that the National River Cleanup Day sponsored by the Santa Clara Valley
Water District was May 20, 2000, from 9 a.m. to noon.
