SUBJECT: Ordinance Adding Section 9- 15.065 to the Municipal Code Relating to
Vehicles.
RECOMMENDED MOTION(S):
None. Review the draft Ordinance and provide direction as appropriate.
REPORT SUMMARY:
Attached is a proposed Ordinance which, if adopted, will assist code enforcement staff and the
Sheriff's Office with eliminating the use of vehicles as living or sleeping quarters. Over the past
few years, there has been a significant increase in complaints filed relating to persons sleeping in
recreational type vehicles or motor vehicles on public and private properties. The current
Zoning Ordinance does not specifically address this concern, therefore the City has been
hampered in its ability to address these complaints.
The Sheriff's office has also expressed concerns about persons sleeping in their vehicles in the
parking lot of the Argonaut Shopping Center. There were three people homesteading on a
continuous basis during the month of June 1998, of which the Sheriff's Office had no means of
legally moving them out of the area. Transients sleeping in their vehicles, are also beginning to
show up in city neighborhoods because they evidently feel safe parking in Saratoga. Residents are
upset that neither the City nor the Sheriff's Office can effectively deal with this problem.
Sleeping or living out of a vehicle promotes blight, and constitutes an attractive nuisance
promoting health and sanitation violations and public safety issues. The proposed Ordinance
drafted by the City Attorney is intended to address these problems by prohibiting living and
sleeping in vehicles with limited exceptions.

ORDINANCE NO. 71-
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SARATOGA ADDING SECTION 9- 15.065
TO THE MUNICPAL CODE RELATING TO VEHICLES
The City Council of the City of Saratoga hereby ordains as follows:
Section 1: Section 9- 15.065 is hereby added to the Saratoga Municipal Code to read
as follows:
"Section 9- 15.065. Vehicles Used as Living or Sleeping Quarters.
No vehicle, including any boat, bus, trailer, motor home, van, camper (whether or not
attached to a pickup or other vehicle) camp trailer, automobile, truck, pickup, airplane, haul
trailer, truck tractor, truck trailer, utility trailer, or any device by which any person or property
may be propelled, moved or drawn, shall be used for living or sleeping quarters, except as
permitted below:
1. Trailers, campers or recreational vehicles may be used by a bona fide guest of a City
resident for a period not to exceed seventy -two hours where the trailer, camper or
recreational vehicle is located on such resident's property."
Section 2: This Ordinance shall be in full force and effect thirty(30) days after its
passage and adoption.
The above and foregoing Ordinance was regularly introduced and after the waiting time
required by law, was thereafter passed and adopted a regular meeting of the City Council of
Saratoga held on the day of 1998 by the following vote;

SUBJECT: Authorization to purchase flail mower attachment for Kubota Tractor
Recommended Motion(s):
1. Move to authorize the purchase of a flail mower attachment from Jenkins Machinery Co. in the
amount of $13,468.86.
Report Summary:
The adopted budget contains $7,500 in Activity 1035 (Equipment Operations), Account 6004
(Equipment) and $6,000 in Activity 3005 (Street Maintenance), Account 4015 (Maintenance Services)
for roadside brush removal which combined, would cover the cost of a flail mower attachment for the
recently acquired Kubota Tractor. The above referenced $7,500 is currently budgeted for the
purchase of a cold planner (pavement grinding) attachment for the City's new JCB Loader, however,
staff feels the purchase of a flail mower attachment for the Kubota Tractor would be of a greater
benefit to the City over time, particularly since the need for and use of a cold planner attachment would
be fairly limited. The past year of heavy rainfall has resulted in heavy overgrowth of brush along many
city streets, particularly those in the hillside areas. The City budgets on average $5,000 per year for
contract brush control work. With the acquisition of the Kubota Tractor the City now has a suitable
piece of equipment for a flail mower attachment which could enable staff to perform roadside brush
control in house, thus saving the City the cost of the annual contract work.
Staff solicited quotations from several equipment companies to provide a flail mower attachment.
However, Jenkins Machinery Co. of Concord was the only company contacted who is able to provide
one that would function on a Kubota Tractor and meet the required performance needs. Please see the
attached quotation from Jenkins Machinery Co. for a total of $13,468.86 which includes tax and
shipping. Consequently, it is recommended that the Council authorize the purchase of the flail mower
from Jenkins Machinery Co. at the quoted price.
Fiscal Impacts:
As noted, there is sufficient funds in the adopted budget to cover the recommended purchase. It
approved, the purchase will save the City approximately $5,000 per year on and ongoing basis for
contract roadside brush control.

Nothing additional.
Consequences of Not Acting on the Recommended Motions:
The purchase would not be authorized. Staff would then solicit bids for roadside brush control.

A Purchase Order for the fail mower in the amount of $13,468.86 will be issued to Jenkins Machinery
Co.

The ALAMO INDUSTRIAL McConnel PA Series Articulated Boom Mowers and Brush Cutters are built with today's un cutt
requirements in mind. This one piece of equipment can mow grass, cut brush, or trim hedges. These articulated booms can reach over guardrails
or down into those hard -to -reach areas like ditches and culverts. They are ideal for cutting grass and weeds around ponds, waterways, and sand
traps on golf courses. The powerful flail cutting head, with drop forged knives, will cut a swath up to 48" wide and may be mounted to operate
on either the left or right side of the tractor. The cutting head can rotate up to 244- degrees giving the operator that extra edge of maneuverability
and is ruggedly built using 11-gauge steel for the deck. The end plates are made o 1/4" thick steel. The hydraulic systems pumps, hoses, and
connections are placed in out -of -the -way locations to prevent damage from snagging on tree limbs, fences, etc. Located conveniently near the
operator, the color -coded control knobs are quickly recognizable and easy to use.

SUBJECT: Status of Library Commission Recruitment
RECOMMENDED MOTION(S):
Direct staff either to prepare resolution appointing Gipstein and Bethel or to continue recruiting
REPORT SUMMARY:
Audry Lynch, the third candidate for Library Commission, has withdrawn due to other commitments. This
leaves the two candidates who have been interviewed, David Bethel and Ruth Gipstein. Since there are two
vacant seats on the Commission, these two could be appointed to bring the Commission up to full strength.
However, if the Council wishes to continue recruiting, staff should be directed to do so.

None
