REPORT SUMMARY: Earlier this year the Planning Commission approved various improvements to the Inn at Saratoga. Some of those improvements are located above a City storm drain. For that reason, the Planning Commission approval required the Inn to obtain the City’s permission to build a structure over the storm drain. The attached easement agreement provides that permission subject to requirements that the Inn bear all costs associated with maintaining (and replacing if necessary) the portion of the storm drain under the Inn’s new structure. Because the easement is an interest in real property, the City’s acceptance of the easement agreement must be approved by the City Council. FISCAL IMPACTS: None significant. The Inn at Saratoga is responsible for all easement maintenance and repair costs. FOLLOW UP ACTION: Record the easement agreement. ADVERTISING, NOTICING AND PUBLIC CONTACT: Notice for this meeting.
