SARATOGA CITY COUNCIL EXECUTIVE SUMMARY NO. eK (c) AGENDA ITEM 6.6 MEETING DATE: October 21, 1992 nQ TY MANAGER APPROVAL ORIGINATING DEPT: SUBJECT: Acceptance of Offer of Dedication of Pedestrian and Equestrian Easement at Saratoga Country Club Recommended Action: 1. Adopt resolution accepting Offer of Dedication. 2. Direct Parks and Recreation Commission to develop a standard trail development condition. Discussion: Since your previous meeting, staff has verified that the trail dedication and improvement condition placed on the Country Club's expansion project has been satisfactorily fulfilled. The condition (see No. 7 attached) requires recording of the trail easement and improvement of the trail "to the Planning Director's satisfaction" prior to final construction approval of the project, both of which have occurred. The former Planning Director approved the trail improvements before he left his job with the City. The Maintenance Director has since inspected the trail and although the trail is not improved to the standards in the Parks and Trails Master Plan, he is satisfied that the trail is in an acceptable condition for the public to use and for the City to maintain. To clarify and standardize trail requirements on future projects, staff is recommending that the Council direct the Parks and Recreation Commission to develop a standard trail condition which could be attached to future project approvals and which would address trail dedication, alignment, design, improvement and maintenance requirements. At a minimum, such a condition should require all trail alignments and improvements to be reviewed and approved at some point by the Parks and Recreation Commission. In the interim, staff has developed a checklist and sign -of sheet to be used to track the fulfillment of trail conditions and the completion of trail improvements. 'The checklist and sign -off sheet will be kept in the project file and will ensure that appropriate City staff approve each step in the trail development process. Fiscal Impacts: There will be a marginal impact to the City's trail maintenance budget as maintenance responsibilities for the trail would be assumed by the City. Attachments: 1. Conditions from Planning Commission Resolution No. UP -90- 006. 2. Resolution accepting Offer of Dedication with attachments. Motion Vote: File No. Up -90 -006; 21990 Prospect Road b. The applicant shall either eliminate the 12 inch lake over- flow pipe indicated on the grading plan at the east end of the lake, or hand dig all trenching within 25 feet of any oak tree under the supervision of the City Arborist. No roots greater than one inch in diameter shall be severed. c. The applicant has chosen to retain a number of tree species which the City's Arborist does not feel are appropriate for this region. The applicant shall present revised plans for the City Arborist's review indicating the incorporation of the alternative species recommendations listed on pages 3, 4 and 5 of his February 12th report. The revised plan shall be submitted to the arborist for review and approval prior to issuance of a zone clearance. d. All required landscape plans shall be subject to the approv- al of the Planning Director prior to the issuance of a zone clearance. Submitted landscape plans shall emphasize drought tolerance and will be evaluated according to the xeriscape standards of the City of Saratoga. In addition, the existing golf course sprinkler system shall be upgraded with restrictive flow heads and rain sensors. 3. The applicant shall obtain all necessary permits for the above ground gas storage tank from the Saratoga Fire District, the Santa Clara County Environmental Health Department and any other applicable agency. The proposed safety netting shall be of one inch dark mesh Olefin fiber net with metal poles painted flat black. 5. All additional new fencing shall be open "hog wire" type with a wood frame and not to exceed 6 feet in height. 6. The applicant shall record a 25 foot "floating" trail easement along Prospect Road to connect the MROSD trail head and staging area with the City maintained pedestrian /equestrian trail ease- ment in the Parker Ranch. This easement shall be recorded to the Planning Director's satisfaction prior to the issuance of a zone clearance. The applicant will not be required to definitively locate or improve this trail easement until when and if the Country Club converts from its current recreational use to anoth- er permitted or conditional use within the R -OS zone district. ■01e. A second 25 foot trail easement shall be recorded to connect the existing City trail system with the MROSD trails to the west, though the actual improved trail need only be 5 feet wide within this 25 foot boundary. This trail shall be staked, reviewed and approved by the Planning Director prior to the issuance of a grading permit. Z a 1 AGENDA ITEM MEETING DATE: Oct ORIGINATING DEPT: SUBJECT: Bonnet Way Soundwall, Capital Project No. 9113 Approval of final design and authorization to solicit bids Recommended Action: Review and approve final soundwall design and adopt resolution authorizing staff to solicit informal bids for the work. Discussion: The final design of the Bonnet Way soundwall is now complete and the plan illustrating the proposed aesthetics of the wall is attached for your review and approval. After two neighborhood meetings and two neighborhood votes, the neighborhood selected a masonry block wall somewhat different in appearance than those along the freeway corridor and reaffirmed the desire for a wall 16 feet in height. The neighborhood has been notified of this item being placed on your agenda and before the Council approves the final wall design, it is suggested that you receive testimony from any of the neighbors who attend your meeting. If the Council approves the wall design, staff is prepared to solicit bids for the work. However, rather than use the formal bidding process, staff proposes limiting the solicitation of bids from only the four freeway contractors presently working on Route 85 in Saratoga. The reasons for this are contained in the findings of the attached resolution which, if the Council adopts, would authorize staff to solicit the informal bids. If the Council adopts the resolution, staff could return with bids and a recommendation for award of a construction contract at your November 4 meeting. If the Council awards the construction contract then, work could begin shortly thereafter and the wall would be built before the end of the year as promised to the Bonnet Way neighbors. Fiscal Impacts: Unknown until construction bids are received, However staff expects that there are sufficient funds budgeted in Capital Project No. 9113 to cover the cost of the project. ,Attachments: 1. That Mr. Gibbs and Mr. Lee, who presently reside in those residences would like to reduce the wall height to ten feet, so we would do a step down at the old terminus of the wall down to the ten foot height that they would desire. I indicated we would be happy to perform the work of extending the wall as an additional work service under the original contract. 2. We discussed the schedule for completion of the work. The present desire is that the project would be advertised for bid starting the 22nd of September. Therefore, of course, the drawings and specifications would have to complete at that time. Bid opening would occur on the 13th of October. The contract would be awarded on the 21st of October, construction would begin December 1 and be completed one month later, just prior to the beginning of 1993. 3. The preparation of conceptual drawings for the neighborhood to select their favorite wall should be completed by August 5, more or less, then forwarded to John Cherbonne. John Cherbonne will then mail those out to the neighborhood for them to vote on. He expects the tally of the vote to be completed by August 17 or so. We would go then forward with the final design details at that point. 4. Also, regarding the conceptual design of the wall, as far as patterns and colors go, Tom Forsythe, one of the neighbors, had indicated a willingness to share some concepts with us. Recommended Acton: Introduce Ordinance to eliminate Passenger Loading Zone designation at same area. ,Discussion: The Principal of the Saratoga Elementary School has requested the City to change the designation of approximately 180 feet of curb frontage along Oak Street from a "White" passenger loading zone to a "Green" 5 minute parking time limit area. The reason for the request is so that parents who need to go into the school for a few minutes can do so and leave their cars parked along the curb. Both staff and the Public Safety Commission have reviewed the request and are supportive of the change. Normally, the establishment of a parking time limit area is accomplished through adoption of an MV Resolution. However, since the area proposed to be changed already exists as a `White' pasenger loading zone, as defined in section 9- 15.100(d) of the City Code (see attached), an Ordinance must first be adopted to remove the passenger loading zone designation. Attached is the Ordinance which staff recommends the Council introduce. At your next meeting, after the second reading of the Ordinance, the Council may then pass the appropriate MV resolution to establish the 5 minute limited parking area. Discussion: As a result of the City qualifying for federal ISTEA funding of the Saratoga Sunnyvale Rd. median project, the Cooperative Agreement between the City and CALTRANS must be amended to reflect the federal participation in the project. Attached is the proposed amendment to the Agreement and a resolution which, if adopted, would approve the amendment. I have not attached the original Agreement which the Council approved on February 5 as the amendment only changes the Agreement from non Federal Aid to Federal Aid. The City Attorney has reviewed the proposed amendment and is satisfied with its contents, Fiscal Impacts: The proposed amendment changes the Cooperative Agreement to allow the City to utilize federal transportation funds to construct the project. The suggestion has been made that an alternate could be appointed in addition to the principal appointees. Several concerns could be raised with such a policy. There may not be enough well qualified persons in the pool to appoint the required number of commissioners plus an alternate. Even if an alternate is found, that person cannot be expected to remain uncommitted and keep current with commission activities indefinitely. The busy, competent people we want on our commissions will find other useful means of occupying their time. Staff does not recommend that the Council routinely appoint an alternate; only the single most qualified person overall should be appointed under normal circumstances. There is one situation, however, in which it might be useful to have the option of appointing an alternate. In February 1985, the Council could not decide between two Library Commission applicants. Both were appointed, resulting in a commission of eight members instead of seven. This situation was anomalous in several ways -one being that tie votes were possible. The situation could have been resolved by appointing one applicant as commissioner and the other as alternate. Although there is no guarantee that the alternate would still be interested when the next vacancy occurred, that person could be confident that he or she would be appointed eventually. Staff recommends that this option be considered. Another option may also be considered. When an unexpected vacancy occurs shortly after recruitment, staff can simply present the Council with a list of previous applicants; since applications are retained for two years, the pool would probably be fairly large. Again, there is no guarantee that previous applicants would still be interested in serving, but it may be worth trying. This has in fact been done from time to time in the past with some success. In general, the Act provides regular employees who have more than one year of continuous service with the City of Saratoga the right to request a leave of absence of up to four months to care for a child, parent, or spouse with a serious health condition, or for the birth or adoption of a child. The Family Rights Act requires that a number of conditions be met before family leave can be granted. We have included these conditions in the proposed City policy. The Act sets forth certain minimum leave requirements, and also requires that Family Leave benefits be comparable to any additional benefits which an employer has granted for other types of medical or personal leave. This policy, therefore, conforms to the conditions of the City's existing policies for medical and maternity leaves of absence. The proposed policy has been circulated to the SEA (Saratoga Employees Association the City's bargaining group), for comment. Following adoption, the policy will be included in the Employee Handbook and Personnel and Administrative Policies Manual. Fiscal Impact: Unknown at this time Attachment: Family Leave Policy /0 FAMILY LEAVE Effective January 1, 1993, under the California Family Rights Act of 1991, a regular part -time or full time employee with at least one year of continuous service may request unpaid family leave for up to one hundred twenty (120) calendar days in a twenty -four (24) month period. Unpaid family leave is available to employees who must care for a newborn or newly adopted child or for a spouse, parent or child who is seriously ill. All requests for family leave must be written and shall be made to the employee's Department Head at least three (3) weeks prior to the requested date for the beginning of the absence unless the need for the leave is unforeseeable. The request is subject to review and final approval by the City Manager. The City may require that an employee's request for leave to care for a child, spouse or parent who has a serious health condition be supported by a certification issued by the health care provider of the individual requiring the care. The employee may elect to use earned leave time during the family leave or may be required to do so. The four-month leave cannot be used in addition to leave time taken off already; however, compensatory time off for overtime worked cannot be counted against the four -month leave time. Any family care leave taken must be for at least two weeks, except that an employee may request a shorter leave (of anywhere from one day to two weeks) on any two occasions during a 24 -month period. If an employee is taking a leave for the birth or adoption of a child, the leave must be initiated within one year of the birth or adoption. Upon expiration of the approved leave, the employee will be reinstated in the position held at the time the leave was granted. The employee will not lose any seniority as a result of the leave. The City will continue to pay its portion of the costs of several benefits (health, life and dental insurance, deferred compensation, and any other benefits subsequently enacted) for the first ninety (90) days of approved family leave. The employee will pay the costs of these benefits thereafter. Certain provisions of the Family Rights Act of 1991 limit the use of family leave, specifically: o For the care of a newborn child, family leave shall be no more than one month when used in conjunction with the maximum leave of four months under the City's maternity leave policy. o Family leave will not be granted for any period of time in which the child's other parent is also taking family care leave from employment or is unemployed. o Family leave will not be granted when doing so would allow the employee and the other parent of the child family care leave totalling more than four months. The City may refuse to grant a request for family care leave made by an employee if this refusal is necessary to prevent undue hardship to the employer's operations. The City may also refuse to grant a request for family care leave made by a salaried employee who, on the date the request for family care leave is made, is among the top 10 percent of the employees in terms of gross salary.
