SUBJECT: Adoption of Merger Ordinance
Issue Summary As part of the code revision process, the City's subdivision ordinance
is also being redrafted. The City Attorney will be recommending various changes to
the existing ordinance, including the addition of a provision for the merger of
nonconforming parcels. The state law on this subject has vacillated back and forth
during the last few years but it would now appear that the Legislature has finally
agreed upon certain requirements for merger which may not be subject to annual
changes, as in the past. Consequently, this would seem to be an appropriate time for
the adoption of a merger ordinance by the City. The new state law (Government Code
Section 66451.21) provides that prior to the adoption of a merger ordinance by any city
not having such an ordinance on its books as of January 1, 1984, the City Council must
first adopt a resolution of intention to enact the ordinance and fix a time and place for
the conduct of a public hearing thereon. Such public hearing must be conducted not
less than 30 days or more than 60 days after adoption of the resolution of intention and
notice of the public hearing must also be published at least 7 days prior to the date of
the hearing. The proposed resolution is intended to satisfy this statutory requirement.
The public hearing has been scheduled for August 21, 1985. In addition to the subject
of merger, the amendment to the subdivision ordinance will also include new
requirements under state law for vesting tentative maps (which must be adopted prior
to the end of 1985) and several other technical amendments to the existing subdivision
ordinance relating to the new exemption from building site approval. A memorandum
describing all of these amendments will be submitted to the Council along with the
proposed ordinance.
