RECOMMENDED ACTION: Approve CDBG Joint Exercise of Powers Agreement and Cooperation Agreement (JPA). REPORT SUMMARY: On April 20, the City Council reviewed the draft CDBG Guiding Principles and JPA. The Council did not recommend any changes to the draft JPA at that time. The Guiding Principles and Local Priorities Plan are still in draft form and will be reviewed by the Urban County Technical Advisory Committee1 (TAC) and approved by the HCD Advisory Committee2. Following review and comment by all of the participating cities3, the final JPA was reviewed by the Santa Clara County Council with minor edits. The new JPA will be for the period October 1, 2011 through September 30, 2014. As previously discussed, the major changes to the JPA include requiring public service applicants and cities to apply directly to the County for CDBG funds. The Cities will be guaranteed a set-aside of capital projects funds4 and be able to specify local priorities for public service funding. The request for CDBG proposals (RFP) typically comes out in November and the deadline for submission is typically the first week of January. The TAC will review all proposals and make recommendations to the HCDAC. The HCDAC will review the proposals at a Public Hearing(s) in February and make a recommendation to the County Board of Supervisors. The County Board of Supervisors will decide which projects get funded and forward the decision to HUD for final approval. FISCAL IMPACTS: Local Providers and Cities will be required to apply directly to the County for Public Service funding and capital project funding. Page 2 of 2 CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The City will not be guaranteed funding for eligible CDBG capital projects and will not have an opportunity to define local priorities in evaluating CDBG applications for the next three years. ALTERNATIVE ACTION: Do not participate in the new JPA for fiscal years 2012-2015. FOLLOW UP ACTION: Forward the singed JPA Resolution to the County. On June 7th, the County Board will hold a Hearing to authorize execution of the JPA agreement.
