SUBJECT: Joe’s Trail at Saratoga De Anza Project – Award of Construction Contract.
RECOMMENDED ACTION:
1. Move to declare Guerra Construction Group of Santa Clara to be the lowest responsible bidder on the
project.
2. Move to award a construction contract to Guerra Construction Group in the amount of $844,014.88
3. Move to authorize staff to execute change orders to the contract up to $250,000.
REPORT SUMMARY:
Sealed bids for Joe’s Trail at Saratoga De Anza Project were opened on February 9th. The City received
15 bids, and these are summarized in Attachment 1. The lowest apparent Base Bid came in at
$844,014.88 and was submitted by Guerra Construction Group.
The low bid of $844,014.88 is 29.6% below the Engineer’s Estimate of $1,198,748.60. Bid amounts were
competitive and quite favorable because of the economy. Staff has carefully checked the bid along with
the listed references and has determined that the bid is responsive to the Notice Inviting Sealed Bids
dated January 12th, 2010.
The planned Joe’s Trail at Saratoga De Anza (Project) includes the development of an approximately
1.3-mile bike and pedestrian trail extending along an approximately 1.6-mile Pacific Gas and Electric
(PG&E) right of way that is approximately 75 feet wide. The trail will extend in a generally
northwest/southeast direction from Saratoga-Sunnyvale Road to Saratoga Avenue in the City of Saratoga.
This Project is funded through a Measure B grant, Congestion Mitigation and Air Quality Improvement
(CMAQ) grant and a private donor who is contributing the mandatory 11.47% local match.
Further, it is recommended that the Council authorize staff to execute change orders to the contract up to
an amount of $250,000 to cover any unforeseen circumstances and address additional work, which may
arise during the course of the project.

FISCAL IMPACTS:
The adopted CIP budget covers the funding for this project. This project will be reimbursed through the
CMAQ grant and donor. The grant and donor will fund the contract amount and the proposed change
order amount.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION:
Guerra Construction Group will not be declared the lowest responsible bidder and a construction contract
will not be awarded to that firm. The Council may make specific findings to declare another bidder to be
the lowest responsible bidder.

FOLLOW UP ACTION:
The contract will be executed and the contractor will be issued a Notice to Proceed. Work will begin as
soon as possible, and be completed by within 80 working days.
