SUBJECT: Adopt resolution amending the City of Saratoga’s Conflict of Interest Code.
RECOMMENDED ACTION:
Accept report and adopt attached Resolution.
BACKGROUND:
The Political Reform Act requires each City and other local agencies to adopt a Conflict of
Interest Code (Code) and to periodically review and update the Code. The purpose of the Code
and financial disclosure pursuant to the Code is to alert public officials to personal interests that
might be affected while they are performing their official duties by making governmental
decisions. Disclosure also helps inform the public about potential conflicts of interest.
The City's existing Code was adopted in 2004 and the Designated Employees List attached to the
Code was last amended in October 2008. As part of the required periodic review, the City
Manager and City Attorney have reviewed the City’s “Designated Employees List” (employees
subject to the provisions of the Code), which is attached as an appendix to the Code, and
recommend that it be updated. The review of the Code consisted of two components: 1) whether
any additional staff should be designated in the Code based upon their participation in the
making of governmental decisions, and 2) the level of disclosure that should be required.
Proposed modifications to the current list would include:
Adding the Information Technology Administrator for disclosure in all disclosure
categories
The attached resolution would amend the City's Code by requiring the IT Administrator to
annually file a Form 700 – Statement of Economic Interest. The IT Administrator is playing an
increasing role in City management decisions and makes recommendations regarding acquisition
of information technology goods and services.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION:
The City's conflict of interest code would not be updated to reflect current City practices.

Forward resolution to affected City staff.
