CWhenthetotofPublicWorksdeterminhatthereasonsforthedefermentofeimprovementsassetforthinSectionIIteheshallnotifyOwnerinwritingtocommencetheirinstallationandconstructionThenotfeshallhemailedtothecurrentownerocLownersofthelandasshoznonthelatestadoptedcountyassessmentrdllThenoticeshalldescribetheworktobedonebyoersthetimewithinwhichtheworkshallcommenceandthetimewithinwhichitshallbecompletedAiloranyportionofsaidimprovementsmayberequiredataspecifiedtimeEachOwnershallparticipateonaproratabasisinthecostoftheimprovementstobeinstalledIfOwnerisobligatedtopayaproratashareofacostofafacilityprovidedbyothersthenoticeshallincludetheamounttmbepaidandthetimewhenpaymentmustbemadeIIIPERF0MANCEOFTHEWORKAtsuchtimeastherealpropertydescribedinExhibitAissubdividedfur7ChrOwneragreestoperformtheworkandmakethepaymentsrequiredbyCityassetforthhereinorasmodifiedbytheCityCouncilOnershallcauseplansandspecificationsfortheimprovementstobepreparedbycompetentpersonslegallyqualifiedtodotheworkandtosubmitsaidimprovementplansandspecificationsforapprovalpriortocommengemehgoftheworasibdinthenotcandopayCityinspetinfeeheworkshallbedoneinaccordancewithCitystandardsineffectatthetimetheimprovementplansaresubmittedforapprovalOwneragreestocommenceandcompletetheworkwithinthetimespecifiedinthenoticegivenbytheDirectorOfPublicWorksandtonotifytheCityatleast48hourpriortostartofworkIntheeventOnerfailstoconstructanyimprovementsrequiredunderthisagreementCitymayatitsoptiondotheworkandcollectallthecostsfromOwnerwhichcostsshallbealienonallthepropertydescribedinExhibitAhereofPermissiontoenterontothepropertyoftheOwnerisrantedtoCityoritscontractorasmabenecessarytoconstructsuchimprovementsIVJOINTCOOPERATIVEPLANOwneragreestocooperateuponnoticebyCitywithotherpropertyOwnerstheCityandotherpublicagenciestoprovidetheimprovementssetforthhereinunderajointcooperativeplanincludingtheformationofalocalimprovementdistrictifthismethodisfeasibletosecuretheinstallationandconstructionoftheimprovementsshouldsuchajointcooperativeplanbeforthcomingpriortofurthersubdivisionoftherealpropertydescribedinExhibitAVREVIEWOFREOUIREbNTSIfOwnerdisagreeswiththerequirementssetforthinanynoticetocommenceinstallationofimprovementsheshallwithin30yBfthedatethenoticewasmailedrequestareviewoftherequirementsbytheCityCouncilThedecisionofthisCouncilshallbebindinguponboththeCityandtheOwnerVIMAINTENANCEOFIMPROVEMENTSCityagreestoacceptformaintenancethoseimprovementsspecifiedinSectionIIwhichareconstructedandcompletedinaccordancewithCitystandardsandrequirementsandareinstalledwithinrightsofwayoreasementsdedicatedandacceptedbyresolutionoftheCityaftertheexpirationofoneyearfromdateofsatisfactorycompletionOwnertomaintainsaidimprovementsatOwnerssolecostandexpenseatalltimespriortosuchacceptancebyCityOwneragreestoprovideanynecessarytemporarydrainagefacilitiesaccessroadorotherrequiredimprovementstoassumeresponsibilityfortheproperfunctioningthereoftosubmitplanstotheappropriateCitoagencyforreviewifrequiredandtomaintainsaidimprovementsandfacilitiesinamannerwhichwillprecludeanyhazardtolifeorhealthordamagetoadjoiningproperty
