REPORT SUMMARY: The City applied for and received $460,851 in Proposition 116 Bond Funds under the Clean Air and Transportation Improvement Bond Act of 1990, for the Highway 9 Safety Improvement Project, Phase III. This project phase includes safety improvements at the Highway 9 and Austin Way intersection, as well as installation of bicycle loops at all signalized intersections on Highway 9 (Saratoga-Los Gatos Road). The California Transportation Commission (CTC) approved the allocation of funds to the Saratoga project at its June 30/July 1, 2010 meeting. Prior to execution of a Fund Transfer Agreement, the CTC requires the City to adopt a resolution stating that no additional state funds will be requested for clean- up, damages, or liability associated with hazardous wastes on or below the project site. The City has conducted an Initial Study/Negative Declaration as required by the California Environmental Quality Act (CEQA) and concluded that the project site does not lie within or adjacent to a hazardous materials site. It is therefore recommended that the Council adopt the attached Resolution certifying that no additional state funds associated with hazardous waste removal shall be requested for this Project. FISCAL IMPACTS: There are no costs associated with adopting the attached Resolution. Page 2 of 2 CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The Resolution will not be adopted and the required Fund Transfer Agreement will not be executed. ALTERNATIVE ACTION: None in addition to the above. FOLLOW UP ACTION: Resolution shall be forwarded to CTC. ADVERTISING, NOTICING AND PUBLIC CONTACT: Nothing additional. ATTACHMENTS: 1. Resolution 2.
