HomeMy WebLinkAboutCity Council Resolution 11-048 RESOLUTION NO. 11— 048 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA ADOPTING AGREEMENT WITH THE CITY MANAGER FOR REDUCTIONS WHEREAS, the City of Saratoga (City) and the City Manager entered into an employment agreement effective September 20, 2007 (attested by the City Clerk September 20, 2007); and WHEREAS, the City Manager has voluntarily agreed to reduce compensation and benefits effective July 1, 2011 as described in the attached Exhibit A to this resolution; and WHEREAS, this Council finds that the provisions and agreements contained in said Agreement fair and proper and in the best interest of the City; and NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Saratoga the terms and conditions contained in the Agreement signed by the City Manager on July 1, 2011(attached as Exhibit A to this resolution) are hereby adopted. The above and foregoing resolution was passed and adopted by the Saratoga City Council at a regular meeting held on the 6 day of July 2011, by the following vote: AYES: Councilmember Manny Cappello, Emily Lo, Jill Hunter, Vice Mayor Chuck Page, Mayor Howard Miller NAYES: None ABSTAIN: None ABSENT: None oward A. Miller, Mayor ATTEST: DATE: 7' g .52--// A ivan, City Clerk July 6, 2011 Agreement for Voluntary Waiver of Compensation and Benefits City Manager Dave Anderson I, Dave Anderson, agree that in an ongoing effort to support the City's short and long term objectives of obtaining a sustainable fiscal position for the City of Saratoga, to modify my current contract attested by the City Clerk September 20, 2007. As background, I voluntarily provided compensation and benefit reductions effective July 1, 2010 through June 30, 2011, including: Giving up the cost of living adjustment in salary (as set forth in my agreement, section III.A.1) Giving up the annual salary increase for satisfactory performance (as set forth in my agreement, section IV.A.) Giving up my monthly car allowance (as set forth in my agreement, Attachment A, section I.F.) Giving up my right to cash out PTO hours accrued above 160 hours (as set forth in my agreement, Attachment A, section II.B.) Effective July 1, 2011 I voluntarily agree to the following compensation and benefit reductions: 1) Retirement: Effective July 1, 2011, I will pay 7% of my compensation on a pre -tax basis for the CaIPERS 2 @55 retirement plan. 2) Reduction in Car Allowance: Effective July 1, 2011, I agree to reduce my car allowance by $125 per month and receive a car allowance of $375 per month. I agree that my other terms of employment remain the same. I understand and agree that the City's acceptance of my offer to forego the benefits described above would not constitute a reduction in salary or benefits for the purposes of section III.A.2 of my current employment agreement. By signature below, I agree voluntarily to the terms in this Agreement as a modification of my existing contract of employment.
