These projects are desired but funding sources have yet to be identified. He wanted one of us to read this for him but unfortunately neither of us could attend this evening's meeting. Please include it in the City Council's packet for tonight's meeting. Qune 2, 2010) Thank you very much, Mayor and Council Members: Instead of appointing someone for two and a half years, you have the clear option of appointing for five months and then having the vacant seat up for election on the November ballot. That option is specified in Government code 36512(c)3. It is black letter law. I explained to you at your last study session that this option was available and that all that was required was that you pass an ordinance to that effect. Since regular ordinances do not take effect for thirty days, and you must appoint sooner than that, the ordinance would need to be passed as an urgency measure. The City Manager reported to you that the City Attorney could give you the findings which would justify the urgency ordinance. At that point, the Council majority fell all over itself looking for excuses to not do that. You worried it would bind future Council's. I explained it was like any other ordinance and could be modified or repealed at any time by this or future Councils. Then you said it would take expensive staff time to prepare a repeal. That is ridiculous on its face and why would a future Council want to repeal an ordinance that allows the City to do the right thing with vacancies? There was discussion that there was some risk because this state statute had not been tested at the appellate court level. I would remind you that half the actions you take are based on state statutes that have not been taken to the appellate court level and tested. The reason you are grasping at straws is that you do not want to admit the obvious. Your campaign promises about citizen participation were hollow and what you want to do is appoint a crony for two and a half years and deny the residents of Saratoga their democratic right to vote for their Council representatives. It's that simple. I would like everyone in Saratoga to recognize that as we sit here, this Council could still change its mind and decide to let us have an election for this vacant seat. I had suggested that you leave the seat vacant until November, when Saratoga residents can elect the Council members they want to represent them. In discussing the situation with other Saratoga residents, I have become convinced that my position on this issue is the opinion of the majority of Saratogans. If you feel that you absolutely must have a 5th member before November, then I urge you to appoint a short term, qualified person who will serve on the Council only until the fall elections. Saratoga residents are just as capable of electing 4 new Council members as they are electing 3 new members. I respectfully offer 2 viable options: 1. Leave Susie's seat vacant until November. 2. Appoint an interim representative, who cannot run for City Council until the next election cycle. Appointing a person to serve on the Council for 2 1/2 years without public input is arrogance beyond acceptance! It is, of course, also undemocratic! Saratoga deserves to elect its own representatives; actually, we demand to elect our own City Council members! Code 54954.2, the agenda for this meeting was properly posted on May 27, 20 10) AGENDA 1. 22480 Mt. Eden Road The applicant has filed an application for annexation approval. The parcel is approximately 2.68 acres. The property is contiguous with the western limits of the City and is within the City's Sphere of Influence and Urban Service Boundary. The property manager will take the Council on a tour of the 2.68 acre parcel and the adjacent 35 acre parcel that was annexed to the City in 2006. As detailed in the staff report, there are many elements to the application that would be considered by the Planning Commission and City Council prior to a final decision on the annexation. The proposal includes a lot merger, adoption of an Agricultural Preserve /Open Space Zoning Overlay, approval of a Williamson Act contract for agricultural land preservation, a conditional use permit and variation from standards for the merged parcels, and design review for a remodel of the existing home and a pre - annexation agreement on the 35 acre parcel.
