SUBJECT: July 24th Public Hearing to Modify Use Permit for
Brookside Club of Saratoga
Dear City Council mcmbcrs:
I would like to express my deep concern over the unfounded
accusations that noise levels are extreme at Brookside Swim
and RacquetClub and its members practice heavy alcohol use.
As I sat and listened to Dee Askew and the other complainants,
I could not believe we were discussing the same facility of
which I am a member and an immediate neighbor. The reason
I joined the Brookside Club was because of its family atmosphere
and quietness.
I am a housewife with two young boys to raise. During the
past six years I have spent numerous hours almost daily at
the club and consider it as my second backyard because it
provides a safe, fun and healthy atmosphere for my children
to qrow up in. The children are also under constant super-
vision. Not once during my six year period of membership
have I observed any of the extreme noise or raucous behavior
suggested by Mrs. Askew. My experience has been quite the
contrary. Usually, there are only half a dozen members enjoying
the club's peacefulness. The noise generated could be no
more than an average residential family would create. I take
offense to her insinuations of alcohol abuse because my children
have always been my foremost concern and I would never partici-
pate in or subject them to =ny unhealthy situaticns as she
described.
Dee Askew complained about the noise level from basketball
playing and the tennis backboard to be a nuisance. I think
it is sad that there are people in our society who are disturbed
by the sound of children playing innocent games such as basket-
ball. With the dramatic increase in latch -key kids, drug
abuse and teen vandals we see today, we need more facilities
such as Brookside Club to provide healthy, family- oriented
activities or just a safe place to hang out for our children.
It is beyond my understanding that anyone would be against
the joyful sounds of children playinq. I must also remind

the complainants that they purchased their homes with the
knowledge of the Club's existance and must accept the circum-
stances (such as a certain amount of noise and traffic) which
go with it. If you were to have moved next to an airport,
would you tell them to stop flying planes because the noise
disturbed you?
My next concern is with Council Members Vic Mor.ia and Willhelm
Kohler. Tt is unbelievable that after sound studies for the
basketball court proved noise levels to be far below city
requirements and the fact there exists a basketball court
in a city park a few yards down the street with a much higher
noise level, they required Brookside to remove the basketball
hoop. Also, the question of how Mr. Monia's requirement for
an 8 ft. fence to be built in the parking lot is going to
reduce noise levels from the club area. There is no noise
generated from the parking lot whatsoever_. I have to wonder
what political reasons there are underlying these decisions.
Mr. Kohler confused me entirely when he agreed the sound levels
as reported in the sound study were reasonable and his personal
investigation found the disputed fence to have dense shrubbery
and trees which provided an acceptable sound barrier and yet
when it was time to vote on the council's recommendations,
he voted against the basketball court and approved Mr. Monia's
fence recommendation.
I feel that if the complainants believe there is a noise problem
in their neighborhood, let them make fence improvements and
other sound barriers to their own properties. It is a complete
waste of the taxpayers time and money for these people to cause
such a disturbance over proven acceptable noise levels by a
club established in our community over 30 years. What a shame
they could not find a worthwhile community service to invest
their energies in instead of trying to take away the privileges
of our children and many well - respected residents of Saratoga.

Dear Council members:
I am a Saratoga resident, residing at the above address for the last
ten years. Last year, I remodelled my house. The construction definitely
created a lot of noise and dust. However, my neighbors endured and
enjoyed with us as our remodelling was completed. Both the neighbors and
I understood the noise and inconvenience to be short-term and a one -time
event (or at least not to continue for another 30 years). That is what I
understand to be "mutual respect" among neighbors. Incidentally, this type
of activity - remodelling, new construction, etc. - constituted 99% of all
requests presented to the Planning Commission for approvals and review -
all "one- shot" events.
In the case of Brookside Club and its neighbors, however, the case is
a bit different. - Brookside Club is a legal entity; a perpetual being existing
in a corporate environment, with its own President and Board of Directors.
And I like to stress the term perpetual. Brookside Club for the last ten
years has apparently been doing well as memberships continlied to be
bought and sold (with profits and inflation adjustments), and the Club has
been successful in increasing its draw for members by obtaining permission
from the Planning Commission in extending their pool hours earlier in the
morning - an hour earlier for adult lap swim, and an hour earlier for swim
meets, so that public swimming can start an hour earlier. And they
extended the use of the clubhouse for many other non-athletic events,
where consumption of alcohol has been alleged and hence h;-ought forth at
this hearing.
During the last decade, I have been present at the Plarming
Commission's hearings on occasions where Brookside Club requested (and
obtained) their extension of services to their members. In those situations,
the neighbors bordering the creek, directly adjacent to the pool (the major
source of high - pitched screams from boys and girls enjoying their
swimming and deck play), asked of Brookside one simple request:
"CURTAIN OR BUFFER THE NOISE SOURCE"
The response to our request was apparent during the last Planning
Commission meeting. They brought out the members en masse, angry
parents portraying these few neighbors by the poolside as the "bad guys"
trying to stop their children from having fun. They apparently were
unable to COMPREHEND other alternatives to "curtain and buffer the
noise source," or else it was their strategic choice to take this up with the
neighbors.
I would like to assure the City Council'that we are not "bad guys,"
keeping kids from having fun. We have a child of our own. However, I
am very much disturbed by the fact that Brookside Club, as a swimming
pool operator, continued to ignore the repeated requests from the
neighbors to do the things that seem to be proper to me.
Let the kids continue to have fun with the water, and ;
If we allow Brookside Club to continue its operations as before, I
can foresee that Brookside Club will continue to ask for further
enhancements of the facilities, and will obtain their requests over the
objections of th -.ir neighbors. After all, they have the massive membership
behind them. The neighbors will continue to be frustrated - frustrated for
30 years too long. We are just too few and too small to fight an
establishment.
However, I believe in our democratic system, and the appeal process,
and that is why I wrote this letter.
Brookside Club has had their way for the last ten years; I would like
to see that the neighbors can have their way for the next ten years. I
sincerely request that the Council impose a 10 year moratorium on
Brookside's operating hours and facilities expansion. Furthermore, I
request that the Council demand that the Club draw up and implement a
good neighbor plan of planting more shrubs around the pool to deaden the
noise. Given a chance for the plants to grow over the next ten years, I am
sure we can enjoy the results for the next few decades.
I sincerely hope that the Council acts favorably for the neighbors
who have the caurage and endurance to pursue their dreams for peace and
security in their own backyard.

Just in time for the summer party season, the
Saratoga City Council has approved a strict law
aimed at clamping down on rowdy booze bashes.
"This is aiming at the adults as well as the juve-
niles," said Eugene O'Rorke, chairman of the city's
public safety commission. "We're not against the kids.
We aren't against parties, but we are against vandal-
ism."
The new law will go into effect May 5, after the
council formally adopts it at a May 2 meeting.

take different tacks at eliminating wild parties and

I've been a resident of Saratoga for 26 years and have been living 2
houses from the Brookglen Ave. entrance to the Brookside Club for
nearly 18 years. I was a member of Brookside for 10 years.
Basically, the neighbors on the west side of Brookside Club have lived
in relative harmony with the Club over the years with a few minor
"tiffs" along the way.
Slowly over the years, Brookside has broadened its influence over
the neighborhood:
1) It added 4 tennis courts with the accompanying traffic
2) It increased. its operating hours
3) Its events still monopolize the streets for parking
4) It has consistently paid little attention to the prohibition of
alcohol on its premises
To Bookside's favor, it has cleaned up its landscaping on Brookglen
Drive and reduced the noise made by the starter signal on Saturday
mornings. We still hear the clunk - clunk of the tennis balls on
Saturday and Sunday mornings.
For us tonight, the issues are:
1)Maintain the prohibition against the use of alcohol
on Brookside Club premises
2)Enforce the use permit condition that alcohol shall
not be used on Brookside Club property
I. Why keep the ban on alcohol use on Brookside Club property?
1)We live in a community that is zoned residential. The
Brookside Club should fade into that residential environment, .
not stick out like a sore thumb. We don't have street lights or
sidewalks - we surely don't need a "drinking club "!
2)Alcohol use has been banned at the Brookside CLub by the
original use permit for 32 years. Why the sudden interest in
changing the status quo?
3)We want "safety" on our streets. Will one member take the
car keys from another member when the latter has reached
the level of 0.08? Will this be measured?
4)If Someone drinks too much at my house house and
subsequently has an "injury" accident, I will be held
responsible
Who has the responsibility and liability at Brookside Club -
the president, the board of directors? Who?
5)Who insures that only those of legal age drink?
II. Why enforcement of the "no alcohol" ban in the use permit is
important!
1)It is unacceptable to the neighbors of Brookside Club that the
use of alcohol cannot be enforced (as per the Planning Staff
report) Schools, theaters public buildings seem to enforce
such laws
2)We suggest that new or more "enforcement" officers be
added to the staff with strict orders to "police" use permits.
3)We suggest that the Club be shut down for several events, or
for a period of time if the Club is caught breaking the rules of
the use permit.
If your child drinks, I'm sure that you would "ground" him /her.
Sometimes organizations e.g. fraternities must be disciplined.
4)We want to stop accidents BEFORE they happen, not after a
tragedy.
In conclusion, please maintain the "no alcohol" use policy in
Brookside Club's use permit, -and enforce this restriction.
