APPROVAL AA�6 SUBJECT: Early Warning Fire Alarm System Recommended Motion: Adoption of Ordinance amending Section 16- 60.020 of the City Code concerning the early warning fire alarm system. Report Summary: The Saratoga Fire District has requested certain amendments to the technical requirements for installation of the early warning fire alarm system, as described in the letter to me from Chief Kraule dated June 6, 1990, a copy of which is submitted herewith. The Ordinance will serve to codify various practices that are currently being followed by the Fire District with respect to newly installed systems. Fiscal Impacts: None. SECTION 16- 60.020 (a) (2) ZONE 6 ELIMINATE DIGITAL ALARM COMMUNICATOR TRANSMITTER LOW BATTERY INDICATION, AND ADD TO BE DETERMINED BY FIRE DISTRICT. SECTION 16- 60.020 (a) (7) CHANGE TO: ALL DIGITAL ALARM COMMUNICATOR TRANSMITTERS SHALL BE CAPABLE OF BEING PROGRAMMED TO SEND SIGNALS, OVER PHONE LINES AND OVER RADIO FREQUENCY TRANSMITTER, THAT ARE COMPATIBLE WITH THE SARATOGA FIRE DISTRICT DIGITAL ALARM COMMUNICATOR AND RADIO FREQUENCY RECEIVERS, WHICH SHALL BE DEEMED A REMOTE RECEIVING STATION. APPROVAL ORIGINATING DEPT: City Attorney SUBJECT: Ordinance prohibiting certain offensive conduct Recommended Motion: Adoption of proposed ordinance. Report Summary: The City has received a request from the Sheriff's Department to adopt a local ordinance to prohibit urinating or defecating in public. Until recently, this conduct was handled as a violation of Section 375 of the State Penal Code, which prohibits the deposit or discharge of "any liquid, gaseous or solid substance ... which is nauseous, sickening, irritating or offensive to any of the senses." However, the State Supreme Court has now ruled that this provision was not intended to control persons who urinate or defecate on public property or in public view. The proposed ordinance is intended to provide direct authority for continued enforcement by the Sheriff's Department (and additional enforcement by the Community Service Officers, since the prohibition now constitutes part of the City Code). A similar ordinance was prepared by the city attorney for Monte Sereno and reviewed by the District Attorney's office. An opinion was rendered by the District Attorney that such ordinance was a constitutional exercise of the city's police power and was not pre - empted by State law. Fiscal Impacts: None. APPROVA� ORIGINATING DEPT: SUBJECT: Passenger Loading Zone - De Sanka Avenue in Front of Blue Hills School Recommended Action: Introduce and adopt Ordinance No. 71. amending subsection 9- 15.100(d) of the Municipal Code to establish a passenger load- ing zone on De Sanka Avenue in front of the Blue Hills School. Report Summary: This matter was brought to the City's attention by the Principal of the Blue Hills School. The request is to establish a passeng- er loading zone in front of the school for parents to use to drop off their children. Hopefully, this will eliminate the practice of parents stopping in the middle of the street to unload child- ren. The Public Safety Commission reviewed the proposal and en- dorsed it at their meeting on June 11. The attached Ordinance, if adopted, would establish the passenger loading zone as shown on the attached map. Fiscal Impacts: Approximately $250 for signage and curb painting. Attachments: 1.
