SUBJECT: Purchase of Recycled Paper Products
Recommended Action: Introduction and adoption of ordinance adding Section 2-
45.095 concerning purchase of recycled paper products.
Report Summary: At the regular meeting on November 1, 1989, the Council
directed the City Attorney to prepare an amendment to the City's purchasing
ordinance requiring that a preference be given to the purchase of recycled paper and
recycled paper products. The proposed ordinance is basically identical to the Santa
Cruz County model, as recommended by the Finance Director and conceptually
approved by the City Council at your last meeting.
Fiscal Impacts: None; the purchase of recycled paper is authorized only where
the cost is comparable to unrecycled paper.

ORDINANCE NO. 71.
AN ORDINANCE OF THE CITY OF SARATOGA
ADDING SECTION 2- 45.095 TO THE CITY CODE
CONCERNING PURCHASE OF RECYCLED PAPER
PRODUCTS
The City Council of the City of Saratoga hereby ordains as follows:
SECTION 1: A new Section 2- 45.095 is added to Article 2 -45 of the City Code,
to read as follows:
"S2- 45.095 Recycled paper
(a) The Purchasing Officer shall establish and maintain procedures and
specifications for the purchase of paper and paper products which give preference,
whenever feasible, to the purchase of recycled paper, and paper products containing
recycled paper.
(b) The Purchasing Officer shall purchase recycled paper and paper
products, instead of unrecycled paper and paper products, whenever such recycled
paper and paper products are available at no more than the total cost of unrecycled
paper and paper products, and when fitness and quality are equal.
(c) The Purchasing Officer may provide a preference to the suppliers of
recycled paper or paper products equal to five percent of the lowest bid or price
quoted by suppliers offering unrecycled paper or paper products.
(d) The term "recycled paper," as used in this Section, shall have the same
meaning as defined in Section 10391 of the State Public Contract Code."
SECTION 2: If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held by a court of competent jurisdiction to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining portions
of this Ordinance. The City Council of the City of Saratoga hereby declares that it
would have passed this Ordinance and each section, subsection, sentence, clause and
phrase thereof, irrespective of the fact that one or more sections, subsections,
sentences, clauses or phrases may be held invalid or unconstitutional.
SECTION 3: This Ordinance shall be in full force and effect thirty days after its
passage and adoption.
The above and foregoing Ordinance was regularly introduced and after the
waiting time required by law, was thereafter passed and adopted at a regular

meeting of the City Council of the City of Saratoga held on the day of
1989, by the following vote:
